Study On Legal Control Of Rural Solid Waste Pollution In China

In recent years,under the dual pressures of population growth and rapid economic development,rural environmental pollution has become more and more serious,especially the problem of solid waste pollution,which has seriously affected the production and life of rural residents.The state has paid full attention to this.In order to improve the rural environment,the central government has allocated nearly 7 billion yuan since 2017 to carry out comprehensive governance in 28,000 villages.In addition to increasing financial input,China has continuously improved environmental legislation,promoted environmental law enforcement,and strengthened environmental justice,providing a good legal environment for rural environmental governance.Under the dual guidance of fiscal policy and legal system,remarkable progress has been made in the treatment of rural solid waste in China.However,in order to solve the rural environmental problems thoroughly,continuous efforts should be made in relevant policies and legal systems.Under the background of implementing the new concept of development in an all-round way and adhering to the harmonious coexistence of man and nature,this paper expounds the concept of rural solid waste,the types of rural solid waste and the pollution status quo in China by using the concept of green development and coordinated development,and sums up a series of problems of legal treatment.On this basis,the current law of rural solid waste pollution in China is summarized.The legislative,law enforcement and judicial aspects of legal governance are systematically sorted out and evaluated.While fully affirming the achievements,the shortcomings of the legal governance system of solid waste pollution in rural areas in China are emphatically analyzed.In terms of legislation,although a relatively complete environmental legal system has been initially established,there are some outstanding problems in some areas,such as legislative gaps and lack of systematicness of existing laws and regulations.In terms of law enforcement,we should change the original leadership system,implement vertical leadership of environmental supervision organs below provincial level,and set up environmental protection Institutes in townships(towns,streets),so that grass-roots environmental protection law enforcement can get rid of local areas to acertain extent.Protectionist intervention,but the lack of enforcement power and weak enforcement capacity of grass-roots environmental law enforcement agencies still hinder the enforcement of rural environmental law.Judicially,the quality of grass-roots judicial staff in our country has been continuously improving,and the environmental judicial trial has been specialized,but the problems of farmers' environmental rights protection difficulties and the defects of environmental public interest litigation system still exist.At the same time,it introduces the achievements of some developed countries in the legal treatment of rural solid waste pollution,and finds out the relevant experience worthy of learning and learning from our country.Finally,a series of ideas on how to improve the legal treatment of rural solid waste pollution are put forward.Firstly,it establishes the principles and systems of the legal work of rural environmental protection,establishes scientific legislative ideas in legislation,establishes special legislation for the prevention and control of rural environmental pollution,pays attention to the construction of grass-roots environmental protection organizations in law enforcement,grants enforcement power to environmental protection organizations,and establishes the legal aid system concerning agriculture and perfects the environmental public interest litigation system in judicial aspect.Through the improvement of the above aspects,a coordinated and efficient legal system for the treatment of rural solid waste pollution will eventually be established.Maintaining fairness and justice and guaranteeing people's personal safety are the ultimate goal of the law.At present,the rural environment in China is facing serious pollution problems,which have threatened the lives and health of rural residents.Therefore,the construction of a scientific and efficient legal control system of solid waste pollution in rural areas is an important means to ensure the personal safety of rural residents,and the key to the realization of green and healthy development of rural economy.
