Research On The Local Legislation Of Municipal Solid Waste Classification In China

So far,46 cities across the country have initiated waste sorting work,launched a series of innovative explorations,and achieved certain results.However,there is currently no good solution in the exploration of garbage classification mode in various places.Urgently improving the legal system for the classification and recycling of municipal solid waste needs new entry points in the context of the new era.The author believes that "local legislation" is a point worthy of study and attention.In the field of environmental governance,the reality,operability,and urgency of local legislation,as well as the revision of the "Legislation Law" and the expansion of local legislative power,provide good subjective and objective conditions for local legislation to treat urban waste.In the field of garbage classification and recycling,more and more anticipated roles should be played.Under the above background,this article will integrate the basic theories of environmental law and circular economics,using literature analysis,normative analysis and comparative analysis methods,and divide it into six parts.Research and discussion on the local legislation of garbage classification and recycling.The beginning is an introduction,which introduces the research background,the significance of the topic selection,the research status at home and abroad,the research content and the main research methods;the research goals of the article are clarified.The second part is an overview of municipal solid waste classification.It mainly introduces the relevant concepts of urban domestic waste classification and recycling in China,clarifies its concept,theoretical basis and practical value,and highlights the necessity of implementing urban domestic waste classification.The third part discusses the legal system of municipal solid waste classification and recycling in China,from the standardization system of urban solid waste classification system to local legislation research,and summarizes the trend,practice status,and problems of local legislation on municipal solid waste classification.The fourth part compares the patterns and experiences of developed countries in the legislation of municipal solid waste classification,and absorbs nutrients for local legislation in China.The fifth part is to perfect the legal countermeasures of the legal system of municipal solid waste classification and recycling in China.Mainly put forward legal countermeasures from the aspects of improving the garbage classification system,improving the relevant administrative legislation,and supervising the classification of urban domestic garbage.The last one part is the conclusion of this article.It is hoped that through summarizing the practical experience of the real world,the legal sample will be put forward to solve the problems of local legislation and the lack of operability and lack of outstanding legislative effect.The governance model of garbage classification and recycling in China determines that the local legislation has strong administrative characteristics,which also puts forward higher requirements for the legislation related to administrative behavior and the capacity of the administrative department.
