With the rapid development of economy and urbanization in our country, the living standards of residents are constantly improving, followed by the continuous increase of garbage, resulting in the phenomenon of "garbage besieging the city".Therefore, the treatment of urban residents' domestic garbage has become the top priority for us to build an ecological and beautiful country. In order to deal with the current situation of "garbage besieged city",in addition to improving citizens'awareness of environmental protection and establishing relevant punishment systems,we should also study the phenomenon of "garbage besieged city" from the perspective of law,and then properly regulate the classification and recycling of urban garbage. There are three problems in the current legislation of urban waste classification and recycling in China:one is the low level of specialized legislation;the other is the lack of basic principles of waste classification and Recycling Legislation;the third is the unclear responsibilities of the government, producers and public residents.Based on the current situation of legislation on the classification and recovery of urban garbage in China, and drawing lessons from the legislative experience of the classification and recovery of urban domestic garbage abroad, this paper puts forward two ways to improve the legal system of the classification and recovery of urban domestic garbage. The first way is to improve the classification and recovery of urban domestic garbage The second way is to improve the relevant legal system, such as classification system, garbage charging system, reward and punishment system, retroactive system.
