Research On Environmental Administrative Law Enforcement In Hekou District Of Dongying City

With the continuous development of the economy and society,the role of ecological civilization construction in social development has become increasingly important,and the importance of environmental protection has gradually become more prominent.The "Environmental Protection Law of the People’s Republic of China" officially came into effect on January 1,2015,and the new Environmental Protection Law was hailed as the "Strict Environmental Protection Law." The promulgation of the "Strict Environmental Protection Law" also marks that China’s environmental protection work has entered a new stage,and to some extent,it has solved the problem of "high compliance costs and low illegal costs" for enterprises.With the promulgation and implementation of various laws such as the Environmental Protection Law,Water Law,Atmospheric Law,and Environmental Impact Assessment Law,higher requirements have been imposed on environmental law enforcement.Environmental law enforcement is an important task of the environmental protection department,and it is also the front-line law enforcement of environmental protection.Grass-roots environmental law enforcement is different from the supervision detachment and supervision corps,and needs to directly face various complex environmental petition problems and environmental violations.This article analyzes the current situation of environmental law enforcement in Hekou District of Dongying City,and combines the environment of China’s environmental law enforcement to seek improvement measures and implementation suggestions for environmental law enforcement in Hekou District of Dongying City.This article applies public product theory,external effect theory,and collaborative governance theory,and uses research methods such as literature survey,case analysis,and comparative analysis to study the concept of environmental administrative law enforcement,law enforcement basis,and implementation methods.By introducing the basics of Hekou District,The situation includes convenient basic explanations of geography and humanities,as well as an introduction to the environmental situation of the estuary area.The current situation of environmental law enforcement in the estuary area is studied.Geographically,due to historical issues such as a large number of flower arrangements,Shengli Oilfield,and Jijun Base,Hekou District has brought great difficulties to local government supervision and environmental law enforcement.In recent years,in order to do a good job of environmental law enforcement in the estuary,environmental protection special departments such as the Environmental Protection Committee of the Estuary District,the Water Vapor and Soil Working Office of the Estuary District have been set up successively,and a grid management system for environmental protection has been implemented.However,the Hekou Environmental Protection Bureau currently has insufficient number of environmental law enforcement personnel,faults in its age group,large number of environmental letters and visits,and lack of environmental law enforcement equipment.From the current status of the environment in Hekou District,the study found that the following problems exist in environmental law enforcement in Hekou District: First,the responsibilities of environmental law enforcement are unclear,there is no clear division of responsibilities between the departments directly under the district,the responsibilities within the unit are unclear,and there are many areas of flower arrangement.The procedures for dealing with environmental issues across regions and departments are still complicated;the second is weak law enforcement forces,insufficient numbers of law enforcement personnel,grassroots configuration and knowledge reserves,and lack of specialization in law enforcement;the third is insufficient enforcement measures and no environmental protection agencies Enforcement means such as industry and commerce,taxation,etc.,enforcement can only rely on the people’s court,with a long execution cycle and low implementation efficiency.There are many reasons for the problem.On the one hand,the implementation of the environmental law enforcement management system is not in place.The environmental protection duties and law enforcement methods such as the grid management system,the environmental law enforcement inspection system,and the vertical monitoring and monitoring system are difficult to implement.On the government side,there is still a lack of investment in environmental protection law enforcement.Most of the funds cannot be used for environmental law enforcement construction,resulting in a lack of law enforcement equipment;there is still insufficient publicity and education on environmental knowledge,and the company does not pay enough attention to environmental protection work.People’s understanding of environmental protection work is not high.Facing the practical problems of environmental law enforcement supervision in Hekou District of Dongying City,according to the analysis of the reasons for the problems in law enforcement supervision,based on theories of national intervention theory and public management theory,this article proposes the following countermeasures: First,all departments and units with environmental supervision responsibility should Joint action to ensure the implementation of environmental protection responsibilities and form a law enforcement synergy;the second is to strengthen law enforcement capacity building,improve the quality of law enforcement of grassroots personnel,increase investment in law enforcement funds,and improve environmental law enforcement equipment;the third is to build a more effective enforcement force,Increase the enforcement of environmental protection enforcement;Fourth,strengthen environmental publicity and education,increase law enforcement,strengthen public environmental awareness,and actively guide the public to participate in environmental protection work.
