Research On The Improvement Of Administrative Interview System For Environmental Protection

Environmental protection administrative interview is a new supervision method in the field of environmental protection in China.The original intention of this system is to implement the environmental protection responsibilities of local governments and realize the transformation from "supervise the enterprises" to "supervise the government",so as to give play to the strong role of the government in the field of environmental protection.And the system in the governance of local environmental problems on the effect is obvious,illegal responsibility is strict,thus causing widespread concern,and gradually more local environmental protection departments.In the new era,it is necessary to legalize the administration of environmental protection in China,which can regulate and control environmental problems effectively and provide important legal system guarantee for the steady development of environmental protection in China.However,due to the absence of administrative interview provisions in the upper law and the lag of academic research,the theoretical construction of environmental protection administrative interview encountered many difficulties,such as unclear definition of its nature,imperfect supporting legal mechanism,low binding force of the interview and other issues surfaced.Will be combined with practical examples,this paper analyzes the problems existing in the environmental protection administration interview practice,and thus reflects the system,put forward to promote the perfect path of questioning environmental protection administration under the rule of law in our country,put forward the rules of conduct for questioning should be environmental protection administration rules,take the administrative rules and regulations to the administrative rules and regulations of progressive legislation process,put forward the "due diligence exemption" point of view,and supervision after the participation main body,questioning proposes ways to the perfection of the system.
