| We should uphold the rule of law under the leadership of the Party and build a socialist ecological civilization.Both the inner-Party laws and regulations and the national laws of China are part of the system of socialist rule of law with Chinese characteristics.The General Office of the COMMUNIST Party of China Central Committee and the General Office of the State Council have jointly issued the Regulations on The Supervision of Ecological and Environmental Protection of the CPC Central Committee,which is China’s first intra-Party regulation in the field of ecological and environmental protection.However,ecological and environmental supervision in China involves not only party organizations,party members and party affairs,but also administrative organs,non-Party leading cadres and social and public affairs.In addition,the power of environmental protection supervision is also a power.If the power is not restricted and regulated by laws and regulations,it is easy to infringe on the rights of the public and deviate from the track of a country ruled by law.The first part mainly introduces the theoretical overview of environmental supervision in China’s administrative system.It mainly analyzes the administrative nature and the evolution of the nature of environmental supervision in China from the relevant documents,regulations,schemes and common expressions in political life of environmental supervision in China.The second part focuses on gannan Tibetan Autonomous Prefecture as an example to analyze the effectiveness and difficulties of environmental supervision work.First of all,it analyzes the system of environmental supervision and the results achieved.Secondly,the results obtained in the analysis depend on normative documents,and on the authority of the central government over the local authorities and the superior over the subordinate authorities.In the end,the paper concludes that the current situation of the operation of the analysis of two aspects of the dilemma,on the one hand is the impact of the administrative system,on the other hand is the lack of legal basis.The third part mainly introduces the enlightenment of foreign administrative inspectors and environmental inspectors to Our country.Because foreign environmental inspectors are of administrative nature,administrative inspectors have limited influence levels and scope,which makes it difficult to form effective constraints for local Party committees and governments.Party inspectors in the nature of party work cannot punish other subjects of environmental responsibility.So it is very important to explore the administrative legal regulation of environmental supervision.The fourth part mainly gives legal advice from the two aspects of improving the administrative system of environmental supervision and establishing and perfecting the legal system of environmental supervision,solving the dilemma of power source,forming the working mode of combining regular inspectors with temporary inspectors,and strengthening the construction of environmental supervision team.The legal system of environmental protection supervision should be established and improved from the following three aspects: the connection between party regulations and national laws,the legal rank of environmental protection supervision,the responsibility of environmental protection supervision and other environmental responsibilities. |
