Comparative Study Of Environmental Law Enforcement Systems In China And The United States

Environmental law enforcement,including environmental justice and environmental administrative law enforcement,mainly refers to the activities of competent environmental protection authorities and their personnel in enforcing environmental law.After more than 40 years of development,China has established a relatively complete environmental law enforcement system,which plays an important role in China's environmental protection work.However,at present,China's environmental law enforcement still faces many problems,such as too many law enforcement agencies restricting each other,insufficient law enforcement supervision,single law enforcement method,insufficient public participation,improper planning of ecological restoration funds,etc.All of which constantly affect the effect of environmental law enforcement.Western developed countries have paid early attention to the issue of environmental law enforcement and have improved the development of environmental law enforcement mechanism.Among them,the United States,as a typical representative of developed countries,is one of the countries with the earliest and most comprehensive environmental protection legislation and the most complete environmental protection system.The development of its environmental law enforcement system has typical significance.We should draw lessons from the advanced experience of the development of environmental law enforcement system,combined with China's national conditions,strengthen the law enforcement team construction,encourage public participation in environmental law enforcement,strengthen environmental law enforcement effect.This paper compares the environmental law enforcement systems in China and the United States from the following five aspects:the establishment of environmental law enforcement agencies,the supervision mechanism of environmental law enforcement,the public participation mechanism of environmental law enforcement,the implementation of environmental economic penalties,and the enforcement of environmental criminal laws,find out the points worthy of our country's absorption and reference,puts forward five suggestions:improving the status of environmental law enforcement departments,improving the vertical management system of environmental law enforcement,strengthening the status of the public in environmental law enforcement,establishing the system of environment reconciliation and funding,and constructing the system of environmental police.In order to improve the environmental law enforcement system of China.
