With the rapid development of social economy in various countries,environmental impact assessment systems have been established in order to prevent the adverse environmental impacts caused by the implementation of planning and construction projects.In 2002,China promulgated the law of environmental impact assessment in China,establishing a legal system of environmental impact assessment in line with China's national conditions,fully reflecting that China aims to build a resource-conserving and environment-friendly society and promote the harmonious development of human beings and nature.The environmental impact assessment system is the basic system of the ecological environment management system,a powerful measure to fight pollution prevention and control,improve the quality of the ecological environment,and an important legal guarantee to promote high-quality economic development.Environmental impact assessment system at the 18th party congress as the important content of the reform of the system of ecological civilization,and put forward a sound source to prevent the fourth plenary session of the party's 19,realize the whole process control,the establishment of the ecological environmental protection of damage compensation responsibility system,deepen the reform of the environmental impact assessment system and build a new system of the rare opportunity.At present,the legal system of environmental impact assessment in improving the ecological environment quality,the environmental impact assessment system for the main source of prevention system has played an important role.But compared with developed countries still exists a certain gap in our country,this paper chose the first compares the environmental impact assessment system of the United States,from the historical development of environmental impact assessment in China and the United States and the current situation of legislation.By studying the comparison of the environmental impact assessment system of China and the United States legislation purpose,evaluation objects,evaluation content,evaluation procedure,public participation and so on related content,draws the experiences of the environmental impact assessment system,put forward under the new situation Suggestions on perfecting the environmental law system in China,in order to realize the national health and welfare for the legislative purpose,expand the object of the legal system,the provisions of the file must include alternative,perfect the procedure supervision mechanism,refining the public participation system to promote the new development on the ecological environment protection is of great significance.
