Research On China's Rural Water Pollution Prevention Legal System

In recent years,with the improvement of the level of economic development in rural areas in China,the village environment has gradually become an important standard for residents to measure the quality of life.However,there are still many problems in the ecological environment of rural areas in China.Among them,the problem of water pollution is gradually exposed to the public vision.During the writing of this article,through the collection of data and field visits,I deeply felt the serious water pollution situation in rural areas,which seriously affected the production and life of rural residents.Although China revised the Environmental Protection Law in 2014 and the Water Pollution Prevention and Control Law in 2017,due to the negative impact of the dual system of urban and rural areas in China,water pollution prevention and control in rural areas has been legislated,enforced and judicial There are still many problems at the level.On the one hand,it is not conducive to improving the village living environment and the living standards of residents;on the other hand,it is not conducive to the construction of ecological civilization.From the perspective of the legal system of rural water pollution prevention and control,this paper analyzes the actual and theoretical necessity of water pollution prevention and control in China from the current situation,sources and characteristics of water pollution in rural areas of China.The regulations on pollution prevention and control summarize the deficiencies of China's rural water pollution prevention and control legal system from the three levels of legislation,law enforcement,and justice.Studying typical legislation for rural water pollution prevention outside the region,drawing on the experience of rural water pollution prevention in the United States,Japan,and the European Union,drawing up special laws for rural water pollution prevention,refining pollution prevention standards,and establishing incentive economic incentive mechanisms to improve China's rural water pollution prevention legal system.The improvement of the legal system for the prevention and control of rural water pollution can not only alleviate the situation of water pollution in rural areas,but also help farmers to enter the constitution,implement the nationalecological civilization strategy,and improve the environmental tort system.The improvement of the legal system should also conform to the national conditions of the country.Based on the problems arising from the implementation of China's water pollution prevention legal system,it provides a way to improve China's rural water pollution prevention legal system.In order to improve the legal system for the prevention and control of rural water pollution in China,we must first improve the legislation and change the concept of legislation.The legislation on water pollution prevention and control is tilted to rural areas,and we must refine the laws and regulations or related systems in order to formulate operable laws and regulations;Secondly,we must establish and improve the law enforcement system,improve the efficiency of law enforcement personnel,and improve the law enforcement system to ensure the smooth progress of environmental protection work.Secondly,we must establish a special environmental justice system,establish the legality of the "three trials in one" trial model,and establish the environment Judicial specialized trial rules,and promote the improvement of environmental judicial specialized trial system.
