Research On Protection Function Of Rule Of Environmental Law Of Inner-party Regulations

Inner-party regulations play an important role in the socialist rule of law with Chinese characteristics and are an important part of the socialist system rule of law with Chinese characteristics.Inner-party regulations also play an important role in the field of environmental protection,which can guarantee the development of rule of environmental law.Under the background that the ruling party is committed to the construction of ecological civilization,inner-party regulations will play a brilliant role in the construction of environmental law and ensure the stability of environmental law.Therefore,in the background of the vigorous construction of ecological civilization and the background of the rule of law of the flourishing inner-party regulations of environmental protection,this paper discusses protection function of rule of environmental law of inner-party regulations.The first chapter mainly explains the basic theoretical knowledge of inner-party regulations,in order to clarify the research object of the paper.This chapter includes the basic concept of inner-party regulations,the nature of inner-party regulations,the discrimination between inner-party regulations and similar concepts.The first section based on the official definition of the inner-party regulations,analyzes the differences in the concept of the inner-party regulations,and then determines that the inner-party regulations can be divided into broad and narrow sense,and the inner-party regulations mentioned in this article are the inner-party regulations in broad sense.The second section expounds the concept of "law",which includes the law formulated by state organs and the normative system created or developed by non-state subjects,and holds that inner-party regulations also belong to law,and are special types of law,namely social law,inner-party law and soft law.In the third section,due to the fact that there are some similar concepts that are confused with the inner-party regulations in practice,the inner-party regulations and their similar concepts are analyzed.The second chapter mainly discusses two issues,namely,what is the meaning of "protection" in the "protection function of rule of environmental law of inner-party regulations",and what is the legal logic of the application of inner-party regulations to rule of environmental law.The first section expounds that protection function of rule of environmental law of inner-party regulations is closely related to the function of inner-party regulations and the characteristics of rule of environmental law.Under this condition,the "protection" in the "protection function of rule of environmental law of inner-party regulations" is shown as follows: inner-party regulations rely on their own constraint function and social function,guide Party and government leaders to care about the construction of rule of environmental law,and form a social demonstration effect,which provides institutional momentum and promotes the development of rule of environmental law.The second section summarizes the legal logic of protection function of rule of environmental law of inner-party regulations into four basic levels: the rule of environmental law faces the dilemma,the ecological civilization into the constitution,the chinization of rule of environmental law,and theinner-party regulations are the basic components of the socialist system rule of law with Chinese characteristics.The third chapter analyzes why inner-party regulations have the protection function of rule of environmental law,interprets protection function of rule of environmental law of inner-party regulations,and proves protection function of rule of environmental law of inner-party regulations through textual investigation and practice inspection.The first section is the text investigation of protection function of rule of environmental law of inner-party regulations,including the text sorting and the purpose investigation.The text sorting is the review of the existing inner-party regulations on environmental protection,and then the purpose investigation is carried out on the basis of the existing inner-party regulations on environmental protection.The second section takes the practice of the specific environmental protection inner-party regulations system as the research object,and mainly examines the practice of the central ecological environmental protection supervision system,the ecological civilization construction target evaluation and assessment system,and the accountability of Party and government leaders for damage to the ecological environment system.The fourth chapter studies the improvement of protection function of rule of environmental law of inner-party regulations,and rectifies the deviation of protection function of rule of environmental law of inner-party regulations.This chapter subdivides the problems existing in protection function of rule of environmental law of inner-party regulations into the problems of standardization,systematization and long-term effect of environmental protection inner-party regulations,the problems of making up the loopholes of the environmental protection laws,and the social guidance problems of protection function of rule of environmental law of inner-party regulations.Then,the paper puts forward the countermeasures,that is,to strengthen the standardization of environmental protection inner-party regulations,to strengthen the systematic and long-term construction of environmental protection inner-party regulations,to fill the loopholes of environmental protection laws with environmental protection inner-party regulations,and to strengthen the public participation and publicity of environmental protection inner-party regulations.
