| The petroleum and natural gas pipelines are one of the fundamental national infrastructures,which can promote national development,guarantee social stability,and improve the quality of public life as well as the development potential of a nation.Oil and gas pipelines are one of the country’s important infrastructures.They can play a role in promoting the development of the country and ensuring social stability.It is related to the overall development potential of a country.With the rapid development of my country’s economy,the country’s and society’s demand for oil and gas resources continues to increase,and the scale of oil and gas pipelines continues to expand.The Medium and Long-term Plan for Petroleum and Natural Gas Pipelines Network says that the estimated national network scale will reach 169,000 km and 240,000 km by the year of 2020 and 2025.The construction of petroleum and natural gas pipelines network will again enter a rapid development period.But with the popularity of oil and gas pipelines,it also brings more safety risks to society and the public.Due to the flammability and explosive property of the resources,once the pipelines accident occurs,it can bring serious damage to the nation,society and the public.Currently,China has a relatively high pipeline accident frequency,which is reported to be 3 times/1000 km,and is way higher than that in USA with 0.5 time/1000 km and Europe with 0.25 time/1000 km.One reason behind this situation is the technical issues of the pipelines itself and other one is that thepipelines protection work is not well performed by local government.The main cause for local movement ’ s failure in taking this responsibility is the existing flaw in current liability system.Under a situation where petroleum and natural gas pipelines are becoming more and more popular,the protection for pipelines is related to the public safety and national development,and its performer,the local government plays a key role.Therefore,the importance of the topic,petroleum and natural gas pipelines protection liability system for local government,is self-explanatory.The first part of the article discusses the current issues existing in pipelines protection work by local government and the flaws in related liability system,and extends an in-depth analysis of the systematic rationality of local government ’ s responsibility in the protection work.In the end,based on the research into American liability systems and our national conditions,the suggestions for designing the system are put forward.Firstly,a more reasonable division of right and responsibility should be achieved between government and enterprise as well as central government and local ones in the top-level system designing.The pipelines protection law should be adjusted to perfect the liability system from its root.Secondly,the supporting detailed regulations and local laws need to be enhanced,which can increase the operability of the pipelines protection system.Thirdly,the related mechanism for local government’s protection work needs to be improved to gain a better efficiency.At last,a proper incentive mechanism requires being set up for local government to increase its motivation.The mechanism consists of two parts,fiscal encouragement from positive side and responsibility assessment from the other side.By the means of above suggestions,it will help local government to play a better role in pipelines protection and increase its efficiency,thus benefiting the overall national development,social stability and public safety. |
