With the rapid development of the economy and the ever-increasing competition in the manufacturing industry,enterprises need to face the numerous patent barriers set by industry leaders when entering the international market.Patent circumvention design is an innovative approach to obtaining new technologies which are different from the target patent's protection scope by analyzing and designing patents of target competitors.Compared to traditional mechanical product innovation design methods,patent circumvention design is based on the technical foundation of the target patent,which has a higher starting point for innovative design and is significant for enterprises to bypass patent barriers set by competitors and avoid infringement of patent rights.It can also shorten the product development cycle,reduce R&D costs significantly,thus enhance the competitiveness of enterprises quickly.Therefore,innovative design of mechanical products based on patent analysis and circumvention plays an increasingly important role in enterprise competition.To determine the core patents of competitors in the target area quickly and then circumventing design For enterprises have become a realistic and pressing issue.At present,researches relating to patent circumvention are mostly based on a single patent or patent groups,which can obtain circumvention programs successfully,but the circumvention targets of which are not core patents in the field of technology.Therefore,the degree of innovation in patent circumvention results hardly be guaranteed.There are two main problems in patent circumvention design.On the one hand,Target patent quality is difficult to guarantee;On the other hand,Patent circumvention design methods less consider improving function and reducing costs.This paper studies the quality evaluation and circumvention design methods of target patents,conducting analysis and circumvention design of target patents from the perspectives of improving function and reducing costs,and proposing an innovative design method for mechanical products based on patent analysis and avoidance.The main research contents of this paper are as follows:(1)This study analyzed the method determining patent quality evaluation index and weight,which is the basis of screening target patent.This study analyzed the evaluation index of patent quality and its selection principle,then building a comprehensive evaluation system of the quality of patent;Analyze the advantages andshortcomings of subjective weighing and objective weighing method,such as Delphi method,AHP method and mean square error decision method.In order to reduce the influence of subjective and objective factors,this paper uses the subjective and objective combination of weighting methods to determine the index weights,establishing a comprehensive evaluation index model for patent quality,then applying it to the evaluation of patent quality in the patent database of the target field,finally,screening target patent with core value.(2)The study of patent circumvention design methods based on improving function and reducing costs.This study analyzes the claims of the target patent,then to determine the main technical features and protection scope of the target patent;from the perspectives of improving function and reducing costs,conducting functional analysis and component value analysis of target patents in order to identify problem components and low-value components in target patents;for the problem components and low-value components,patent circumvention design methods and processes are studied to propose a process model for patent circumvention design based on improving function and reducing costs.(3)The case study of patent circumvention design of non-motor vehicle driveline technology.Based on patent analysis and circumvention of the innovative design method of mechanical products and the process model of circumvention of design,conducting circumvention design of target patents in the field of non-motor vehicle transmission system technology,getting circumvention plans,then making infringement judgments.Finally,these verify the validity of the process model of the patent-circumvention design which is based on improving function and reducing costs.
