Study On Problems And Countermeasures Of EPC Project General Contracting In China

With China’s economic development,the scale of engineering construction projects continued to expand and building requirements continued to improve and the difficulty of project management gradually improved,The management mode of engineering construction needs further improvement.China’s government departments have been actively promoting the use of EPC general contracting mode in construction projects,but the laws and regulations and contract texts of EPC general contracting mode in China are still not perfect.For this reason,this paper makes a comparative study on the management mode of engineering construction at home and abroad.On the basis of this,the paper compared and analyzed the difference between the typical format of contract（trial）of the Construction Project general contracting（GF₂011-0216）,the bidding document of standard design and construction general contracting,and the "Conditions of Contract EPC/Turnkey projects" of FIDIC.The differences in the three contract texts were discussed and it pointed out the shortcomings of the two contract texts in China,and then the problems existing in the national policy and contract of the general contracting mode of EPC project in China were analyzed in the light of the problem of a data center in the actual project using EPC project general contracting mode.The national policy aspect mainly includes the lack of the legal basis of the general contract,the division of the qualification of the general contracting enterprises,the imperfection of the bidding and contract model,the unclear positioning of the supervision work and the low comprehensive quality of the supervisors,as well as the single type of project insurance and the shortage of the market subject,etc.The Division of coordination work with local governments,the control of construction quality and schedule,the responsibility and cost division of production and operation before handover,and the analysis of problems existing in engineering claims.Finally,according to the experience of participating in a data center project management,this paper puts forward some practical suggestions and solutions to the problems existing in the general contracting of EPC Engineering in China.Due to the short development time of EPC project general Contracting in China,the relevant laws and regulations of the state were not perfect,the owners,supervision units and general contractors have insufficient experience in the management of EPC project general Contracting,and the research in this paper was the revision of relevant laws and regulations,The revision and supplement of the bidding text of the general contract of the project,as well as the project management of the parties involved in the construction,provide some reference.
