Study On The Contractor’s Claim Scheme Of ZCHD Project

With the continuous development of China’s market economy,foreign advanced management concepts have penetrated into all walks of life.The increasing number of international projects in the construction market has led to the gradual standardization and legalization of self exploration.As the knowledge of engineering management that came into China late in engineering management,engineering claim has not formed a mature management system so far.There is a lack of combination of theoretical research and practical engineering.In practice,there are not enough popularization of legal knowledge and deep-rooted traditional concepts.Many contractors think that claim is an important way to improve the project profit.Using the strategy of "winning the bid at a low price,claiming profit" to disrupt the legal process of the construction market.How to correctly understand the project claim in the booming construction market today?How to manage engineering claim? These are the problems that we need to solve and explore urgently,and also the important direction of my thesis research.This paper will take zchd project as an example,through the systematic analysis of the characteristics of the project,combined with the construction contract and laws and regulations,and strive to develop a claim management scheme suitable for the project.Zchd project is constructed and used by the Ministry of transport,which is a typical public construction project invested by the government.It is composed of six single buildings and outdoor pipe network.The whole construction area is about 3600 mu,showing the characteristics of small single building area,scattered location and wide outdoor engineering laying area.Due to the fact that the construction permit is not obtained at the time of commencement of the project,the owner requires to carry out small unit construction first,resulting in small construction work surface,unable to form operation flow,construction progress delay,material procurement time can not be determined,etc.;the outdoor pipeline construction site has been expanded and maintained for many times,the existing underground pipelines are complex,and the construction drawings can not guide the site construction,resulting in serious construction efficiency reduction and construction The risk increases,etc.,so the construction unit puts forward the project claim in the completion settlement stage.Through the study of zchd project in construction contract,construction progress,construction difficulty and organizational structure,this paper sums up various claimevents in the process of project implementation,such as deviation from the construction contract,inapplicable management mode,etc.,summarizes a set of claim party cases of the project department,and provides reference and help for similar projects in engineering claim.
