Research On Comprehensive Claim Management Based On Conditions Of Contract For Construction Of FIDIC

Claims management is an important content of engineering project contract management, and is also an issue that project management personnel give much concern in daily management activities. Although the vast majority of construction enterprises can realize the importance of claim management, but in practice they generally have no good idea about how to do it, so the efficiency of claims is difficult to be ensured. It is in this context that research on comprehensive claim management for contractor is conducted in this paper in order to put forward more specific claim management strategies and improve the efficiency of claims management and the effect of enterprise claim.Based on the Conditions of Contract for Construction of FIDIC, in this paper, the combination of literature research and empirical analysis was used to study the issue on comprehensive claims management for contractor. Firstly, the concept of comprehensive claims management was mentioned, which included the whole process, all-around and all-staff claim management in three aspects, and whose basic framework was also tentatively constructed. Secondly, on the foundation of brief analysis to Conditions of Contract for Construction of FIDIC, respectively from the angle of contractor and employer, summarizing the claim clauses in the contract conditions, and thorough analysis was carried on for each claim clause. Then, with the concept of comprehensive claim management as the core, claim management strategies for contractor were discussed, which included contractor claim management general policies at macro level, as well as the claim management strategies on specific claim clauses at micro level. Among them, the key was focused on the discussion about the specific claim and counter-claim strategies for contractor, adopting the method of combination of specific claim clauses and basic framework of comprehensive claims management. Finally, an empirical analysis was conducted about the case of a hydropower station project claim in south of Asia.
