Study On Legal Issues Of Traditional Chinese Medicine Preparations In Medical Institutions

The traditional Chinese medicine preparations in medical institutions are unique varieties developed according to the needs of China's national conditions and have an irreplaceable role in the development of China's medical undertakings.In recent years,with the continuous improvement of the quality requirements of Chinese medicine preparations in medical institutions and the increasing cost of preparations,Chinese medicine preparations in medical institutions are gradually facing a serious situation.With the promulgation of the Chinese Medicine Law,the law has clearly defined the formulation requirements for Chinese medicine preparations in medical institutions in the form of law,bringing new springs for its development.Based on this background,this paper systematically studies the regulatory policies and intellectual property protection systems of Chinese medicine preparations in medical institutions in China,and analyzes the supervision of traditional Chinese medicine preparations in medical institutions through data statistics and simple empirical research.The results showed that the overall development of traditional Chinese medicine preparations in medical institutions in Jiangsu Province was good,and the variety of preparations was sufficient to meet the needs of various types of diseases.However,the development of traditional Chinese medicine preparations in medical institutions in different regions was not balanced,and the preparations were mainly composed of tertiary hospitals and Chinese medicine hospitals.The preparations are affected by commercially available drugs at the time of sale,and the number of patent applications is extremely small.It shows that there are still many shortcomings in the supervision and protection of traditional Chinese medicine preparations.On the one hand,under the current supervision system in China,the development of traditional Chinese medicine preparations in medical institutions is facing great difficulties,such as lacking of perfect quality standards,sales revenue cannot meet production costs,inaccurate positioning of preparations and weak innovation ability of new Chinese medicines.On the other hand,Chinese medical institutions have a weak sense of intellectual property protection for Chinese medicine preparations in the hospital.The main reason is that the patent examination and approval time is long,the preparation characteristics are difficult to adapt to the requirements of patent applications,and the trade secret protection laws are not clear.Therefore,if our government wants to realize the development of traditional Chinese medicine preparations in medical institutions,it is necessary to solve the improvement of China's preparation supervision system,strengthen intellectual property protection,and solve the current predicament.First of all,we must improve China's quality standards system,strengthen the supervision of Chinese medicine preparations in medical institutions,improve its quality standards,simplify the application procedures for Chinese medicine preparations,and explore the establishment of regional preparation cooperation centers;in addition,under the current regulatory system,Medical institutions should also make a difference.They should streamline the varieties of traditional Chinese medicine preparations,develop traditional Chinese medicine special preparations,promote enterprise cooperation,and strive to realize the conversion of traditional Chinese medicine preparations to new Chinese medicines.Finally,in terms of intellectual property protection,medical institutions should,under the full use of patent information,mining patent technology,and strengthening patent protection,seek protection of auxiliary means such as trade secret protection,thereby achieving dual protection and promotion of traditional Chinese medicine preparations in medical institutions.In that case,it will have a long-term development.
