Research On The Supervision Of The ’Plagiarism’ In Chinese Movies And Television Productions

On one hand,the appearance of the ‘plagiarism’ in Chinese movies and television productions,undermines the healthy development of the Chinese movies and TV series productions and broadcasting market,on the other hand,it also destroys the general public’s awareness of ‘intellectual property rights’,affects the social fairness and justice,and tramples upon the basic human conscience and moral bottom line.It is not only an industry problem that needs to be solved urgently,but also a social issue due to the spread and attention it drew.This paper bases on the theory of ‘market failure’ and the regulation theory,starts with the background of the failure of Chinese movies and TV series productions and broadcasting market,by applying depth interviews and data access to make a clear,detailed analysis on Chinese movies and TV series productions and broadcasting of government regulatory agencies and regulatory implementation.Through the depth interviews and specific cases,the writer wants to disclose how the current ‘plagiarism TV series and movies’ phenomenon occurred and developed.Then,through the comparison between the current situation supervision and the reality of ‘plagiarism TV series and movies’,the writer analyzes and lists the causes of ‘plagiarism TV series and movies’ in the field of Chinese movies and TV series that existed for a period of time and has not been cured by government regulations.The factors caused these above problems are: inadequate regulatory basis,loopholes in regulatory procedures,regulatory oversight,weaknesses in the regulator’s single industry,etc.In view of these problems and their causes,this paper argues that improvement of the production and supervision of Chinese movies and television productions,can be made through the following: establish and improve the laws and regulations system,standardize and executive the formulation of government documents,control and supervise the legitimacy of script adaptation effectively before their broadcast,ascertain the responsibility of ‘plagiarism TV series and movies’ sowing agencies after their broadcast,increase the punishment constraints ‘plagiarism TV series and movies’,relax and standardize the contents of regulation to stimulate the original vitality,increase subsidies to strengthen the supports and encouragement to original good drama,establish the effectivesupervision of the regulatory mechanism,identity current supervisory goal scientifically,clarify the importance self-regulation organizations and guide the industry to strengthen their self-discipline policies,innovation and broadcasting mode to further promote the system of production and broadcasting,boost the network audio-visual platform to increase the broadcast port,classify the broadcast of Chinese movies and TV series,and establish a scientific and comprehensive evaluation system of Chinese movies and TV series.Through the views and discussion of this paper,the author aims to provide a different perspective of thinking and solutions for the governance,to avoid the appearance of the ‘plagiarism’ in Chinese movies and television productions from the perspective of government supervision.
