The Study On "Sheni Zuiren"(????) Of The Qin And The Western Han Dynasty

In the period of the Qin and Han Dynasties,the people fled badly,and there were people who hide the fugitives.Wanglv(??)appeared in the fourth volumes of Yuelu Qin bamboo slips,and there are some provisions in Wanglv(??)that involve sheni zuiren(????).This article is based on the materials of sheni uiren(????)in the Yuelu Qin bamboo slips,Zhangjiashan Han bamboo slips and the Historical Records(Shiji),and combine the other unearthed materials and the handed-down documents to carry out the analysis.The crime subject of sheni zuiren(????)of Yuelu Qin bamboo slips is divided into the hiding person,the responsible person,the negative management responsibility and tihe person who is being shed:Those who are hiding include the escaped criminals and the escaped people,and the group with special status,the name of penalty or punishment before the escape of the hiding person constitutes a complete system.The punishment of he criminal subject of the crime of hiding has the difference between the informed and uninformed,and the difference between"shezuiren”(???)and "nizuren”(???),and the difference between "with the same law" and "with the same crime".The parents,sons,the same father or mother,and the husband and wife may offend the law of sheni zuiren(????),and the people will be "hiding" from the slave men and maidservants.The person who has the responsibility to bear a room,the conditions for their being held are over 18 years old and with the person who is hiding in the same time and space,there are "dian(?,tiandian(??),ww(?)”Three kinds of people,the punishment for wealth punishment,more for wealth A or wealth a shield.The situation and the punishment who shall be held jointly liable of dha(?),tiandia(??)?wu(?)are different.Responsible for the management ofxiangbu sefu(????),xiangbulizhuzhe(?????),lingcheng(??)punishment based on a certain time and space,by taren(??)captured the number of fugitives.In the historical records,there are also the materials involved in sheni zuiren(????).From the Yuelu Qin bamboo slips and Liye Qin bamboo slips to the close control of the local government,and the contradiction of the lack of control of Qin Dynasty to the six countries of the Warring States Period,which is embodied in the Historical Records(shiji),this paper puts forward a question that "the degree of control of the six countries of the Warring States Period after the unification of Qin Dynasty."The situation of sheni zuien(????)in the Western Han Dynasty is divided into four stages.The first stage for the Han empire until the Emperor Wen reform of the law of Han,this phase of sheni zuiren(????)case can be applied to the Two Year Laws of Zhangjiashan Han bamboo slips in the relevant laws,zouyanshu(?)in the case also confirm the law.The second stage is Emperor Wen after the reform of the law until some year of the Emperor Wu.The third stage from the Emperor Wu changed sheni(??)as shouni(??)to Emperor Xuan of dijie sinian(????).According to the material shoal,(??)the record of the crime is basically concentrated in this period.The fourth stage was followed by the imperial Edict of dijie sinian(????)summer May of Emperor Xuan.Each period of the situation is not the same,reflecting the Western Han Dynasty,a change in national governance.
