Marx's Notion Of Human Rights In Historical Materialism

Marx's human rights theory,as a quintessence of thought has theoretical impact on practical construction of human rights,has gained much attention since the beginning when it came into existence.This thesis tries to study on the process of the theory from historical materialism view,and tries to provide theoretical foundation for our human rights construction by making this theory as a systematic theory.The appearance of Marx's Human rights theory has the social and ideological background.The overturn of feudalism and the advanced modes of production has established the foundation of system and economy at that time.Also,the Enlightenment and the Classical German Philosophy has provided theoretical foundation for him.The human rights theory at age of Enlightenment and the Classical German Philosophy has great influence on Marx at first.When Marx found the proletarians' human rights were infringed by others,he wanted to ask help for their countries and tried to make the rulers protect proletarian's human rights from legal respect.When it failed,Marx was disappointed at bourgeois government,and turned to historical materialism.He exposited his human rights theory from the realistic person and this was the practicality of his human rights theory.After the thorough analysis on western human rights,Marx revealed the primary reason why the bourgeoisie has made human rights as the privilege of themselves by criticizing Hegel's civil society theory and analyzing the Jewish Question.He believed the departure of civil society and political country has led to the duality of human essence.Also,the alienation labor and the emergence of private property has aggravated the situation of proletariat,and made them have nothing at all.So,Marx stressed that proletariat have to eliminate the duality of human essence and the bourgeoisie to realize the emancipation and the free and all-round development of humans.Marx's human rights theory was based on the critique of modern western human rights,and it was a thorough subversion and transcendence of western human rights.The transcending was reflected that it was based on the realistic person on practical? revolutionary and human emancipation.Also it had different peculiarities of human rights from western human rights theory.The reason why Marx's human theory can be applied to Chinese human rights construction practice is that the oppose of exploit and the realization of liberation of mankind,and it is same as the essence of our country's human rights construction.So I believed Marx's human rights theory can be the foundation of our country's human rights construction.After achieving remarkable achievements in the independence of sovereignty and the construction of human rights,then continuing to strengthen the economic development of our country and the perfection of laws and regulations of human rights and the propaganda of the thought of human rights construction.Finally trying to provide great foundation of our country's human rights development.
