| The thesis is divided into two parts.The first part is the Tibetan translation of the book《on crime and punishments》,and the second part is the theoretical analysis of the theory of Tibetan translation of《on crime and punishments》.The book《on crime and punishments》is not long,but it has far-reaching influence.It is the first book in the history of human beings to systematically explain the principle of punishment.The book was full of humanism,condemned the extortion of confession by torture and the death penalty,advocating the reform of the criminal law and the modern principle of sentencing to suit the punishment of crime and punishment.This book has brought a great reputation to the author and has been translated into many languages.It has a great influence on the reform of the criminal law in Russia,Prussia and Austria.The book is regarded as one of the most important classics in the field of jurisprudence.Since the publication of Chinese translation,crime and punishment has been included in the compulsory reading list of Chinese criminal law practitioners.The author explains the limits of crime,how to prevent crime,crime and punishment,and all natural,social and religious factors related to crime,and embodies the three principles of modern criminal law:the principle of legality of crime,the principle of adaptation to crime and the principle of equality before the law.In content,the author tells his own views from forty-seven chapters.Each chapter contains the author’s different views and different interpretations.In the second part of this thesis,the theory and analysis of the Tibetan translation of crime and punishment,the author and the content of the author are introduced to describe the purpose and function of the translation of this book into Tibetan,the achievements and status of the Tibetan translation of the works of law,the process of translation,the difficult and reconciled solutions and the sense of post translation. |
