Ethical Thinking On Body Problems

The problems of body are an ancient problem.Human understanding for the body has gone through a long and twisting process.For a long time,the body has been misunderstood,indifferent and suppressed,not being accepted by the ideological community.The value and status of the body also suffered from depreciation and didn't received the attention it deserved.It was not until Nietzsche that the “body turn” was opened by Nietzsche that the research about was admitted by the philosophy.With the rise of postmodern philosophy,the research about body has gradually become the core in philosophy,aesthetics,ethics,sociology and other disciplines.However,with the development of modern economy,technology and medical,the problems about human body have become more complicated and faced an unprecedented dilemma.For example,organ transplantation,human experiment,deformation surgery,etc.obscure people's perception of the body.Nowadays,surrogacy,prostitution,self-abuse raise agreement about whether people has right to dominate their own body.The rise of the service industry and the prevalence of consumerism have transformed the body from a labor tool to the object of consumption.Gradually,the agreement for the body raise lots of attention and become more and more controversial.However,the traditional Chinese and Western body view and the bioethics based on the body and mind are unable to respond to the questions and demands raised by the new problems of human body.Now,they are faced with theoretical.Everyone has a body,but few people know exactly what the meaning body is.People often simply equate the body with the physical body or the organism.In fact,the body is not only an organism in the biological sense and a body with a broad nature in the division of mind and body under the traditional consciousness philosophy,but a phenomenon body with multiple levels of meaning and multi-dimensional characteristics.The body has the value of means,but also has intrinsic value,containing the moral value of freedom,dignity and equality.Body rights are the possible practice norms of body value.Body rights are divided into moral rights and legal rights.The two are different and related.The former is the requirement of body value,and the latter is the mandatory realization of body value.But the moral rights of the body do not necessarily lead to legal protection.To this end,in the real world to protect the body and realize its value,to protect the body from insults and injuries,not only need ethical help,but also legal support,but also need to clarify the difference between body moral rights and legal rights.However,in the practice of our country's body rights,the phenomenon of backward body concept,a weak sense of body right and the discrimination and materialization of women's bodies still exist.In addition,the protection of body legal rights still needs to be improved.For example,although China's body rights are already statutory civil rights,body rights are only an abstract concept of rights.Its specific content,scope of application and safeguards are waiting to be clear and perfect.Traditional body concepts and bioethics are not only unable to cope with now the problems of human body,but have difficulty in solving the body problems of China's current body right.Then,based on the body problems of the body right of contemporary Chinese society,to protect the body and realize its value,it is necessary not only to overcome the theoretical dilemmas of traditional body and bioethics,but also to rethink what the body is and to revisit the body.Value and rights,and strive to provide the theoretical basis of moral value and moral rights for the implementation and improvement of body rights in legal practice.
