Research On Evidentiality Of Judgment

With the judicial reforms in our country,judicial justice in the case becomes more and more important.Among them,acceptance is undoubtedly an important pursuit of high-quality judgments,and the evidentiality in the judgments argument — explaining the source and reliability of information,and the close connection between the acceptance of the judgments.Therefore,this paper studies the evidentiality in the judgment.This thesis first explores the evidentiality in the judgment from the theoretical perspective.Combining with the theory of narrow sense of evidentiality and the information sources and characteristics of judgments,this paper classifies the evidentials of judgments from the three perspectives of sharing information,quoting information and personal information,and the subclasses are: the shared information includes legal shared evidential and illegal shared evidential;reference evidential under reference information;the personal information includes reasoning evidential,hypothesis evidential and conclusion evidential.In addition,based on the existing credibility hierarchy research in the linguistics community,the credibility hierarchy of various types of evidentaility in the judgment is analyzed and ranked as follows: legal shared evidential> illegal shared evidential> reference evidential> conclusion evidential> reasoning evidential> hypothesis evidential.On the basis of theoretical research,this paper makes an empirical study of the evidential in judgments by combining examples with statistics.On the basis of summing up the present situation of the use of the evidentials,the influence of the evidentiality in the judgment on the acceptability of the argument is deeply explored.After sorting and summarizing,it is found that the relationship between the evidentiality and acceptance of the judgment has two main aspects: firstly,the credibility of the evidential is positively related to the acceptance of the judgment,including the high credibility of the evidential is conducive to the discussion acceptance,low-credible evidential hinder acceptance of the discussion;secondly,the use of evidentials will have an impact on the acceptance of the judgment.The positive impact is the correct use of shared,quoted,and personal evidentials and corresponding marking;there are three types of negative impact performance: the first one is to mark the low-credible evidentials with the vocabulary that marks the high-credible evidentials;the second is that the information structure of the evidentiality in the discussion is incomplete,including the missing content of the evidentials,the lack of personal reasoning evidential and the single level of the data structure of the evidential;the third is based on low-credible evidential.On this basis,two rules of evidentiality affecting the acceptability of the judgment are summarized: firstly,the tag words of the evidential should be matched as much as possible with the evidential information itself,and the source of the information should be clearly indicated;even if they do not match,the tag words of the low credibility evidential can mark the high credibility data information;secondly,when discussing,should use high-credible evidentials such as sharing information or quoting information as the basis for the conclusion,and use the "high-credibility evidential + personal reasoning process = conclusion" model in the discussion.Finally,on the basis of analysis and empirical investigation,this paper puts forward the following suggestions to improve the expression effect of evidentiality in the judgment so as to enhance the acceptability of the judgment discourse: firstly,the correct form and content of the evidential to improve the acceptance of the discussion;secondly,pay attention to the rationality of personal information;thirdly,improve the quality of the expression of the zero evidential,pay attention to the rules of zero evidential and should be based on the expression of personal information;the fourth,use a rich evidential hierarchy in the discussion.Four modes are proposed in the paper.
