A Report On The Translation Of Judgment INTERNATIONAL UNION, UAW, Et Al. V. JOHNSON CONTROLS, INC.

In recent years,amid the rapid development of Chinese economy,the Chinese government has embarked on a new journey to deepen the judicial reform.In this context,legal exchanges among different countries is extremely crucial.The American legal system may provide valuable lessons for China.Therefore,it is necessary to translate foreign legal texts into Chinese.This report is based on the translation of a judgment(INTERNATIONAL UNION,UAW,et al.v.JOHNSON CONTROLS,INC.)from the Supreme Court of the United States released on 20 March 1991.This judgement discusses the issue over the sex-based discrimination in the workplace,which has a widespread impact on working women and American companies.This judgment is characterized by accurate application of the law and precise logical reasoning and argumentation,which is of great research value.In the process of translation,guided by theories of functional equivalence and legal equivalence,the author analyzes the features of this judgment and encountered difficulties at the lexical and syntactic levels respectively and further decides the corresponding translation strategies.In this report,the author discusses at the lexical level how she dealt with common words with legal meanings,legal terms and abbreviations.At the syntactic level,the author discusses how she handled the passive voice and long sentences which frequently appear in he said judgment.The whole report consists of four parts.In chapter 1,the author introduces the background and significance of this translation practice,giving a detailed analysis of the nature and features of the source text.Chapter 2 includes pre-translation preparation,the applied translation theories,translation schedule and post-translation quality control.Before the translation,it is necessary to perform a lot of work,such as obtaining background information about the judgment,analyzing the source text and reading parallel texts.After the translation,the major task is to proofread the translated text.In Chapter 3,cases are shown to illustrate the translation problems encountered and their solutions at the lexical and syntactic levels.In Chapter 4,the author concludes with some preliminary findings from the translation practice.In sum,through translating the judgment,the author does hope to offer some solutions to the common problems in translating judgments and also to draw more attention to sex discrimination in the workplace.
