Research On China's Legislation In Intellectual Property Rights

From a macroeconomic perspective,intellectual property right in a state where technological advancement is considered as the major criteria for assessing its overall competitiveness,does not only help advance the technological development,but it also strengthens the overall competitiveness of a country.Despite its great importance,the development of intellectual property rights is still limited in our state.Our law protects the intellectual property rights from infringement,yet it overlooks the values of such rights.From a microeconomics perspective,mortgage on intellectual property rights,undeniably,acts as an important channel for small and medium technological enterprises to raise capital.It helps meet their developmental need in circumstances where they lack capital and resources,and prevents the intellectual property rights with growing potentials from being "killed".Mortgage on intellectual property rights opens up a new market and a new business direction for the financial institutions.Nevertheless,in light of the fact that intellectual property rights are the invention of the new era,our legal system is still limited in its ability to deal with it,creating various problems in the state and undermining its development.Thus,there is an urgent need for us to remove the hurdles to the development of mortgage on intellectual property rights and provide sufficient legal protection.This article aims at revealing the difficulties encountered in obtaining mortgage on intellectual property rights from the legislative perspective.In this essay,I would first identify the developmental needs and the legislative background of the laws related to mortgage on intellectual property rights,and then compare and contrast with the reality so as to expose the conflicts between them.Finally,I would provide some suggestions as to how the intellectual property rights laws could be improved with reference to the practical reality of the state.
