The contract has a very unusual role for modern construction projects,and is the highest conduct in engineering activities.Implied terms as well as contract express terms is legally binding,but the current domestic about research of the contract implied terms,which concentrates on the theoretical project,while ignores the practice.That will cause the theory and practice are not uniform,namely,the theory is feasible,the practice is not feasible.Especially when dealing with engineering disputes,it needs to reason,analysis and research the implied terms in the Construction of demonstrative text.On the basis of summarizing the past experience,combining with the FIDIC construction contract conditions,this paper analysises and studys the implied terms of the engineering contract,reduces engineering disputes exist and solves engineering disputes with high efficiency.And it can realize the maximization of the profits and the minimization of the cost of owners and contractors.Firstly,this paper describes the significance of construction project contract implied terms under FIDIC conditions,research status at home and abroad and problems of in the study,research objectives,research significance.Secondly,departure from the contract theory,it gives a new discussion of the meaning of the contract implied terms,the legal effect and the classification.It analysises implied terms whether it is necessary,and researches the judge how to reference the implied terms.According to terms of the contract of our country's construction project construction contract demonstration text,implied terms contained in it are analyzed in detail.Lastly,it gives conclusion and outlook.Theory combined with the actualg,it uses three engineering examples to study the implied terms of the contract.And it points out that the shortcomings of demonstrative text.
