On Protection Of The Third Party’s Rights In Open Government Information

Based on the research of the open government information and the status of personal information protection legislation,the dissertation plans to analyze the protection of the third party in the disclose government information upon application.The administrative organs don’t perform their duties in accordance with the program regulations;the administrative organs public citizen information without distinction;the reasons of rejedt information disclosure are not corret.These are the main problems exposed by the prctice and cause adverse effects.For example,the objection channels of the third person are uncomfortable;the administration of justice are more difficult.Then the dissenrtation provides some suggestions through referring to draw lessons from foreign experience,and analyze the causes,as the following several aspects: the administrative discretion right needs to be limited;the relationship of applied information publicity and personal information protection should be get out of this mess;the program making process should be standard;the way of relief for the third person should be expand,etc.
