The Protection Of The Rights Of Irregular Migrant Workers In International Law

The wave of economic globalization has led to dramatic increase of irregular migrant workers in the worldwide.The irregular migrant workers are a special group of economic value,illegality and vulnerability,whose rights are subject to seriously infringe.According to the principle of freedom of migration and the principle of equality and non-discrimination,the international community has established some international documents of human rights relating to the protection of the rights of irregular migrant workers,especially the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families lists rights to irregular migrant workers.On the basis of international documents of human rights,the international community has formed an international protection mechanism in human rights that provides procedural safeguards and remedies for irregular migrant workers' rights,including monitoring bodies and implementation regimes.But,the international community is not perfect for protection of the rights of irregular migrant workers.There is divergence between human rights and sovereignty in theory.International documents of human rights have problems of less number and application.The internationalprotection mechanism in human rights has some shortcomings,such as the low efficiency of monitoring bodies and the more limitations of the implementation regimes.Faced with these deficiencies,the international community should increase the international responsibility of sovereign states that urges them to apply international documents of human rights relating to the protection of the rights of irregular migrant workers,increase international documents of human rights and its contents for the protection of the rights of irregular migrant workers by strengthening international cooperation,and perfect the international protection mechanism in human rights by improving the efficiency of monitoring bodies and reducing the restrictions of implementation regimes.All of this is in order to protect the rights of irregular migrant workers fully and timely by establishing a unified and effective international standard.
