In June 2016,the State Council of China issued "the opinions of strengthening the security work of troubled children".It classifies troubled children into three categories.The first is troubled children due to their own reasons which cause those children to be tough to recover from diseases and to integrate themselves into society,including disabled children and children with serious illnesses;The second is the family troubled children who are difficult to receive full-time education and reach acceptable standard of living due to low household income and wealth,including left-behind children and children in minimal assurance families;The third kind is children with predicament of guardianship,including waifs,orphans and children with drug-taking parents Troubled children's own characteristics determine them to be difficult to participate in the process of social development to enjoy the achievement of society progress equally and freely,which violates the core of development right.The right to development is one of the most elemental human right,it should be accomplished from ought-to-be state to reality.French thinker Rousseau mentioned in his Emile to help the child grow up is one of the important principles of all needs related to the physiological needs,whether in the aspect of rationality or physical aspect,must be to help them make up the lack of them."In order to avoid troubled child to be bystanders to the progress of times,we must build up the guarantee system for troubled children and improve their right of development and construct established environment for free and fair competition.Through analyzing the concept of troubled children and their right of development,this article clearly illustrates the four elementary categories of development right for troubled children as followed:economic right to development,social right to development,cultural right to development and political right to development In practical terms,the economic right to development convers the labor right and enjoyable right of economy process for troubled children.The social right to development refers to receiving fundamental needs for survival including social insurance,medical insurance and minimal assurance.The cultural right to development can guarantee troubled children equally to receive full-time education,special education and vocational education and also enjoy the benefit of culture progress and acquisition of information.The political right to development ensures the legal rights and obligations of troubled children.This article lists present development dilemma for troubled children of different categories and deeply analyzes corresponding reasons from four angles,family,school,society and country.Meanwhile,this article offers clear advice on legislation guarantee judicatory guarantee,administrative guarantee and organization guarantee.Only combing those solutions and promoting them together can protecting the development right of troubled children effectively.
