Research On The Legal Aid System By The Mode Of PPP

Legal aid is a basic human rights system established by the government to ensure the poor citizens obtain free legal services,embodying the fundamental principles of "citizens are equal to the law".In practice,the contradiction between the demand and supply of the free legal services is prominent;the main reason lies in the confusion of rights and obligation between the public and the private,which manifests that the administrative obligation is transferred to the legal service personnel.The legal service is also a commodity,which is distributed and supplied under the market,so the government neglects its market value in payment of social legal services with limited funds.In the study,only the relationship between rights and obligations of government and the private conformed to the rule of law economic so that the value of legal aid system can meet the needs of government,practitioners and the recipient.The advantage of the PPP mode is not only to solve the difficulties of financing public service projects,but also to fully protect their respective interests.The legal aid without payment from the end user can be supplied by market,which is in the scope of PPP mode.The legal aid with PPP mode opened up a new path for the improvement of the human rights protection system in China.It can truly become a high quality free public legal service products.
