Research On The Investment Facilitation Of China-ASEAN Free Trade Area

Regional economic integration is a significant feature of the world economic development.At the same time,international investment,equal to international trade,has become one of the pillars of international economy.With signing the China-ASEAN Free Trade Area Upgrade Negotiation Results Document,and China and the ASEAN on the revision of the Structure Agreement on General Economic Cooperation between China and the ASEAN(Hereinafter referred to as the "Protocol"),the economic relations between China and the ASEAN have been deepen.The mutual investment between China and the ASEAN has become the focus of all parties all over the world.The study on how to promote the development of investment facilitation between China and the ASEAN has become more important.This thesis attempts to study the history and current situation of the development of China-ASEAN Free Trade Area,and to study the new development of the Protocol on its investment facilitation.Based on the theory of international investment law and regional investment rules,and according to the bilateral investment agreements among member countries and the China-ASEAN Free Trade Area Investment Agreement,the issues of investment facilitation under China-ASEAN Free Trade Area are studied.The thesis is divided into five chapters,and the specific arrangements are as following:In Chapter 1,the background and significance of the thesis are introduced.The research situation at home and abroad,the research contents and methods about the thesis are summarized in detail.In Chapter 2,the development process of the China-ASEAN Free Trade Area is firstly introduced,and the favorable conditions,the developmental scale and investment characteristics of mutual investment between China and the ASEAN are emphatically introduced,to point out the development requirements of the investment facilitation under China-ASEAN Free Trade Area.In Chapter 3,the laws and regulations related to the investment between China and ASEAN are analyzed,especially on the most important one,the China-ASEAN Free Trade Area Investment Agreement.Unlike the bilateral agreements signed between the China the ASEAN in the past,the China-ASEAN Free Trade Area Investment Agreement aims to coordinate the investment activities between China and the member countries of the ASEAN,which belongs to multilateral investment agreement in the category of international law.So in terms of investment,there is no more authoritative legal documents than the China-ASEAN Free Trade Area Investment Agreement,which can be taken as the institutional guarantee of the investment facilitation under the China-ASEAN Free Trade Area.In Chapter 4,the new contents of investment facilitation in the upgraded version of the Protocol are introduced,from the interpretation of content changes to the promoting impact of the upgraded version of the Protocol.Through the case analysis of the China-ASEAN Information Port and two industrial parks,the promoting impact of investment in the upgraded version of the Protocol is verified.In Chapter 5,through the research on the China-ASEAN Free Trade Area Investment Agreement and new developments of investment facilitation in the upgraded version of the Protocol,and considering the new directions and ideas in the development of international investment,the solutions to the existing problems in the investment facilitation under the China-ASEAN Free Trade Area,in order to play a positive role in policy formulation of investment.
