The Problems Existing In The Protection Of Tourist’s Rights And Interests And Countermeasures

Now more and more people choose to travel in leisure time as an important way of a pursuit of spiritual enjoyment.However,due to the lack of sound laws and regulations,standardized tourism contract,and effective supervision and others in China’s tourism industry,tourism disputes often occur and the interests of tourists couldn’t be effectively protected.In this regard,how to further protect the interests of tourists,which has become an important research topic.This thesis deeply studies the problem of protection of tourists’ rights and interests in the tourism market at present,draws lessons from the experience of the developed countries and puts forward the relevant solutions according to the special national conditions of China.The main contents of this thesis are divided into two parts.The introduction part summarizes the background of the thesis,the significance of the research,the research status at domestic and abroad,the research methods and so on.The main text deeply studies the problem of the protection of the tourists’ rights and interests,and puts forward the corresponding countermeasures through the five parts.The first part mainly analyzes the related concepts of the protection of tourists’rights and interests.It confirms the concept of tourists,analyzes the meaning of the tourists’interests,and sums up the characteristics of the tourists’interests,in order to lay the foundation for the discussion below.The second part analyzes the problems existing in the process of protecting the tourists’ rights and interests in China from four aspects as below,which is tourism-related laws and regulations,tourism administrative supervision,tourist relief,tourism contract and so on.It points the way to perfect the protection mechanism of tourists.The third part mainly studies the current development model of the developed countries in the United States,Japan and France,and further understands the status quo of the protection of foreign tourists’ rights and interests,and puts forward some revelation and reflection from successful experiences of foreign tourists’ Protection.The fourth part mainly analyzes the countermeasures of the problem in the protection of tourists’ rights and interests in the second part,and puts forward some concrete measures and suggestions in the aspect to improve the tourism laws and regulations system,strengthen the supervision of tourism administrative supervision,perfect the tourist relief way,standardize the tourism contract and others.In the fifth part,on the basis of the above,it puts forward three suggestions,which strengthens the consciousness of activism of tourists,introduces the compensation system of tourists’ mental damage,strengthens the supervision of trade associations and introduces public participation supervision,so as to further perfect the tourists’Rights protection mechanism.
