Research On Criminal Legislation Of Terrorist Activities

The crime of terrorism has been hated by all over the world,since twenty-first Century,the occurrence of terrorist crime blowout state.In 2001,the United States"9.11 incident" opened a global prelude to terrorism,and then a series of terrorist attacks broke out in China.The range of activities spread from Xinjiang and Tibet to the middle and eastern parts of china.2014 KunMing Railway Station in Yunnan "3.01 violent terrorist case shocked the world,8 Xinjiang separatists in the train station killed 31 people,wounded 141 people,31 fresh young life from a stop.The criminal law amendment(nine)promulgated at the end of 2015 has made many additions and modifications to the relevant contents of terrorist crimes,and then promulgated the anti terrorism law.The introduction of these laws to further improve the legal system of criminal terrorist activities in our country,the anti-terrorism legislation in China to a new level,to a certain extent,improve the lag of China's criminal legislation on crime of terrorist activities and lack of.However,compared with some foreign countries which have rich experience in anti-terrorism legislation,China's anti-terrorism legislation is far from enough.In recent years,China's "East Turkistan" terrorist organizations and foreign terrorist forces colluded with a large number of goods and funds from abroad for the development of terrorist organizations.It has brought great risks to our national security,social stability and the people's health and safety.All these require us to build up a strict legal system with the criminal law as the crack,the administrative law as the prevention and the criminal procedural law as the sanction through the construction of anti-terrorism legislation.The two laws adopted in 2015 have played an important role in improving the legal system of terrorist activities in china.But for today's terrorist crimes,showing the new characteristics of collectivization,normalization and expansion,it is necessary to perfect legislation with the times to carry out a more comprehensive attack and prevention.First of all,this paper discriminates some concepts in terrorist activities,reviews the progress of anti-terrorism legislation in China,and introduces the criminal activities added and modified in the criminal law amendment(nine).Then lists some representative countries' legislation concerning terrorist activities,and analyzes the main differences between China and foreign countries in anti-terrorism legislation.The main features of China's anti-terrorism legislation are summarized,mainly showing the characteristics of helping the principal offender,preparing the action and protecting the legal interests.Not only after the event of terrorist acts of punishment,and early intervention in the early stages of the bud,terrorist activities in the cradle of crime,more attention to crime prevention.Finally,some suggestions and suggestions on how to carry out anti terrorist legislation are put forward,in order to adapt to the current trend of terrorist activities.Through the improvement of China's criminal legislation against terrorism,we can better safeguard China's national security and social stability,and form a legal pattern of "giving priority to punishment and coordinating all laws".While improving our domestic anti-terrorism legislation,we should also strengthen cooperation with other countries and international organizations.Only when all the countries in the world work together to build a global legal network against terrorism and reach a consensus on anti-terrorism,can terrorist crimes be no longer a common threat to all mankind.
