A Study On The System Of Leniency On Acceptance Of Guilty And Acceptance Of Punishment In China

High number of criminal cases in China in recent years,increasingly light tiny proportion of the criminal case,due to the limited judicial resources,in some cases persisting,the judicial organs are under great pressure.In such legal background,the fourth plenary session of the Party's 18 clearly put forward "Leniency on Acceptance of Guilty and Acceptance of Punishment" as a judicial system,not only can use the law to punish the crimes,and the victim can get compensation in time.It saves the judicial resources and alleviate the pressure of the judiciary.Although in theory are not set up a standard system of "Leniency on Acceptance of Guilty and Acceptance of Punishment",in the judicial practice has been to explore.Introducing the system of "Leniency on Acceptance of Guilty and Acceptance of Punishment" in criminal proceedings has its necessary value of existence,but to make the system play their value in the judicial practice,it is necessary to establish the corresponding guidelines and operating process.The purpose of this thesis is to pleaded the system of "Leniency on Acceptance of Guilty and Acceptance of Punishment" as foothold,from the system to its background,basic concept and value,comparing the system in the foreign countries,especially the system of Plea Bargaining and other similar,to find the system in our country inpractice and theoretical research on the existing problems and improving suggestions accordingly.
