Research On The System Of Sentencing Recommendations Of The Procuratorial Organs

Since the sentencing proposal has been carried out in the criminal procedure of our country in 90s,it has attracted great attention from the theoretical circle and the practical circle.Especially in 2005,the Supreme People's Procuratorate promulgated the "Supreme People's Procuratorate on Further Strengthening the public prosecution work to strengthen the legal supervision of the opinions",clear and actively explore the sentencing suggestion system requirements and significance,emphasis on sentencing recommendations is a necessary measure for the procuratorial organs at all levels to strengthen judicial supervision,and as an important content of the reform of criminal procedure at the beginning,the formal implementation of the national procuratorial organs.After nearly ten years of practice,the procuratorial organs have carried out the work of sentencing recommendations,and actively explore and carry out theoretical summary in the judicial practice,and achieved some experience and results.But since the country did not establish a unified system of sentencing suggestion,resulting in theory is controversial,in judicial practice there is a great difference.Therefore,it is an urgent need to construct the system of sentencing recommendations and regulate the judicial practice,which is not only the inevitable requirement of the idea of governing the country according to law,but also the great background of the reform of the judicial system.This article focuses on the improvement of the public prosecution system and the strengthening of the judicial supervision,the system of sentencing recommendations to the procuratorial organs.
