Risk Identification And Prevention Mechanism For The Mineral Energy Trust In China

Since traditional trust patterns,such as trust-bank corporation and real estate trust,were shrined sharply recently,the mineral energy trust has become an new growth point of profit for Chinese trust companies.Although,according to the data form Wind in 2011?In2015,the amount of mineral energy trust reached a peak at around 300 billion Yuan,lots of risks and problems,such aslegal risk,market risk,were revealed in the past two years.And these lead to a decrease of the development of mineral energy trust.This dissertation is divided in to four parts.Part one will introduce Zhongchen Trust and the heuristics plan project information,the basic plan of process,through a brief analysis of the cause and the incident also makes we should reflect and bring about some inspiration,that is to improve the information disclosure,comprehensive due diligence,strengthen management and supervision the necessity of the problems to be solved.Part two are the introduction of Chinese mines and energy trust and the analyze of risks under mines and energy in China.Including the dependence of mineral energy trust;the United States,Canada's Energy Trust Fund for the development of today's polar energy trust Large reference;investment model mainly covers trust loans,equity investment,equity investment and investment portfolio;mineral energy trust internal and external legal relationship analysis to entrust pledge.Part three elaborates all kinds of risk problems of mineral energy trust in the field at present,influence of risk analysis.Including legal risk,valuation risk,management and operation risk.The legal risk is the most important,it covers the problem of mining rights,legal structure of mineral enterprises more confusion,the form of guarantee is single,the mining enterprises or its shareholders rights the debt relationship is complex,investment penetration,serious problems such as the legal liability involved;valuation risk is a special risk of mineral energy trust;management and operational risk refers to the risk caused by man-made risks,management personnel or fault intentional violation of the procedures;the last part put forward the construction of China's current mineral energy trust risk prevention mechanisms,including the transfer of the right to review the good end mining and reasonable mechanism enhance,improve the information disclosure mechanism,trust mechanism and multiple mechanisms,in order to make a better development in the future of China's mineral energy trust.In order to indentify and prevent these hazards,this dissertation will discuss the potential risks under the mineral energy trust by analyzing the case “Zhongcheng trust--chenzhijinkai No.1”(Zhongcheng Trust),one of typical cases analysis of mineral energy trust seemingly high profits behind its potential " high risk ",elaborates the mineral energy trust risk types,and puts forward some corresponding preventive measures on the risk sources the construction,risk prevention mechanism,to strengthen the future of mineral energy trust mainly on the law of avarious types of risk management,which not only increase the hope and confidence of investors of mineral energy trust investment,but also provides valuable reference for the future development of Chinese trust industry.
