The Study Of The System Of Conditional Non-prosecution In Social Work Intervention

As an important role in juvenile justice system,the conditional non-prosecution system is a basic one in the field of juvenile delinquency,which acts as the role to educate minors and save them,after their breaking the law.The conditional non-prosecution system serves its special nature because of its involvement in minors.Therefore,it should be made in the aspects of legislation,law enforcement,education,supervision and so forth,according to the physical and mental characteristics of minors.The system provides chances to minors for their fresh-strat whith the characteristc of cautios punishment and creates a good opportunitities to them for being better man,which highlights the special field in the prevention of punishment to the realization of social justice,equity,the long-term stability and a harmonious society.The "Criminal Procedure Law" in 2012 enables minors to the conditions without prosecution.Howerver,the conditional non-prosecution system of legislation and justice is still in its development stage,not comprehensive nor standard.In the course of the study,the author summarizes the problems of the conditional non-prosecution system in our country at this stage.It is an indispensable part for the system to help and educate the minors criminal suspects during the conditional non-prosecution.To get the work done smoothgly and to ensure the fair operation of the whole mechanism,it may helps the young people to repent and get back to the society.So,it is a necessity for the involvement of the social work.On the basis of understanding the relevant system of conditional non-prosecution system and judicial social work,the author has carried on the practice inquiry to the social work service in the conditional non-prosecution system and made it clear to the intervention in the conditional non-prosecution system with a deep and better understanding,through the literature research,field investigation and other research methods to explore and summarize the judicial social work in the condition of non-prosecution system.At the same time,the author can see its problems and therefore offers the suggestions at the stage of social work and practical involvement during the whole process.
