The Establishment And Improvement Of Legal Supervision System Of Private Investment Funds

With the rapid development of the asset management industry in our country,all kinds of products are fast increasingly,participation subjects are numerous.There is a significant influence on social and economic at the same time,so the industry development and regulation are facing new challenges.Private investment funds developed very fastest as a type of asset management business.In the most important part,the more industry scale development growing,the more risks are accumulating as risk events are exposed.As a high-risk investment,how to build and complete the legal regulation system is a very important job for the protection of investors.Since 2016,the asset management fields and private investment funds have been enacted a large number of new regulations and guidelines,the China Securities Regulatory Commission(CSRC)and Asset Management Association of China has adopted a series of measures,punished several private equity firms and personnel suspected of illegal,in order to promote and guide the industry toward to a standard and healthy development.In this paper,combining with the author's own social practice experience in private asset management companies,under the analysis of the current private investment funds,at the basis of a number of new rules,combined with the practical cases,the author want to discusses the private investment funds managers may produce legal compliance issues in the operation,mainly for privateinvestment funds related transactions of prevention and the improvement of the private securities investment fund information disclosure system.In the perspective of investor protection,how to establish and improve the legal regulatory system of private investment funds,I would like to make some of my own thinking.Namely in the face of the present situation and the existing problemsof China's private investment funds industry development,we should not only have a reasonable system of legal regulation,but also we should effective implementation in practice,carry out the bottom line regulation.When the active and moderate supervision practice combined well,then we can protect investors' rights and interests better and finally to promote the effective of private capital at the same time.Therefore,this paper argues that how to build and perfect legal supervision system,such as private investment fundsrequires the legislature to perfect the relevant legal revision,industry self-discipline organizations should have a great importance to the protection and education of investors,private investment funds managers strengthen internal risk control and management.The various main compliance from the investor protection,construct diversified industry regulatory system architecture,to ultimately promote the healthy and sustainable development of private investment funds industry.
