Research On The Legal Protection Mode Of Web Page Layout

With the development of network technology,web page version of the legal protection issues follow.For the legal protection of the page layout,both the development of the copyright system to the digital stage of the problem,but also the Internet under the birth of a new anti-unfair competition behavior regulation.The main reason for this problem is that at present,there is no legal law on the copyright of web pages in China,and in the "Anti-Unfair Competition Law" listed in the 11 The specific anti-unfair competition is also difficult to both the protection of the page layout,the legal absence of the phenomenon and the judiciary and the judiciary in dealing with the page layout problem can not find the basis.However,the production process of the page layout is not in accordance with the objective laws of the objective things simple arrangement,the designer will be a comprehensive design of various elements,to pay a creative work.In view of this problem,this paper intends to discuss the construction of reasonable web page version of the legal protection model,in order to achieve full and effective protection of the page layout.This paper is divided into four chapters:The first chapter expounds the basic theory of web page layout and the main problems of legal protection.It mainly defines the meaning,classification and legal characteristics of the page layout,and on this basis,it makes an in-depth analysis of the nature of the page layout,clarifies the main problems of the current legal protection and lays the foundation for the discussion.The second chapter discusses the copyright protection mode of web page layout.Secondly,it introduces the experience of using the copyright law as the main protection method,and aims to guide the improvement of the copyright protection of the Chinese version of the web page by analyzing the international advanced experience.At the same time,it analyzes the legitimacy of the copyright protection of the web page layout in the current copyright theory.Finally,the advantages and disadvantages of web page copyright protection are discussed.The third chapter discusses the main mode of anti-unfair competition law of web page layout.This chapter first discusses the legitimacy of protecting the layout of the webpage through the anti-unfair competition law.Secondly,it introduces and analyzes the specific legislative experience of the relevant international treaties and countries.Finally,the advantages and disadvantages of the anti-unfair competition law protection mode are analyzed.The fourth chapter mainly elaborates the protection of the web page pattern in our country,and explores the enlightenment of the extravagant experience to the improvement of the page layout protection in our country.This chapter first discusses the current situation of the protection of web pages in our country,introduces the legal basis and the confusion of the protection mode in judicial practice and the different judicature of judicature.And then from two aspects of the proposed recommendations: on the one hand,in the comprehensive consideration of China's Internet development stage and the characteristics of the two kinds of protection model,based on the proposed webpage format infringement to establish anti-unfair competition law regulation,Legal Protection Mode Supplemented by Copyright Law.On the other hand,the paper puts forward two suggestions on the protection of anti-unfair competition law in the page layout,that is,in the legislation mode of our country at this stage,we should first include the page layout as a kind of commercial identification into the protection category of specific unfair competition;Secondly,we should learn from the German anti-unfair competition law type of regulation,and gradually clear and specific provisions of our general terms of regulation.
