The position of the court clerks in our country is the adjutant of the trial.The primary job is the transactional work in the trial process.In the wave of Judicial Reform,the clerk is one of the important parts.There are three types of court clerks,divided into the appointment system,engaging system and employment system.In reality,the shortage of clerks,greatly mobility,the quality is not high and other problems frequently appear.However there is not enough staff to engage in the work,so that the effect of judicial reform greatly reduced.This article focuses on the midland Court,conducted a brief analysis of the central region and the central region of the court,we can conclude the current number of cases constantly grow year after year.Secondly,from the judicial reform for the requirements of the clerk,it makes clearly the duties of the clerk,classification,work content,the corresponding theoretical basis and the excessive loss of clerk impact on the work of the Court.And through making a brief ananlysis of the clerk working conditions,such as remuneration,workload,facility environment and promotion space we have the initial understanding of the work of the clerk.Then we sort out and investigate the clerks,who had left court in all courts of J City of J Province recently,and the type of personnel survey,to understand the reasons for their departure.Combined with interviews and survey data,it concludes the factors affect the loss of the court clerk are mainly wage treatment,job stability,work intensity,family factors and promotion opportunities.The dual system of labor leads to the difference between the compilers and those who have no compilers.The work intensity is mainly due to the long working hours pay and return is disproportionate,the length of work on the impact of female loss is more obvious than men,and different age,academic qualifications of different clerks are different reasons for leaving.Finally,in view of the loss of the clerics faced by the Court,combination with the requirements and expectations of the central government on the judicial reform and the experience of the reform of the clerks system,the author puts forward some suggestions on the current situation,and thinks that the professionalization of the clerks should be established in,radicate recruitment conditions,improve remuneration,broaden the promotion of space and attention to the needs of mind and body to start,in order to solve the problem of the loss of clerks.
