Study On Procuratorial Supervision Of Property Punishment Execution

The constitution of China's procuratorial organs is a state specific functional organ for legal supervision.It supervises the legal activities carried out by the investigation organs and judicial organs according to law,including the effective supervision of the activities of the execution of the penalty.In recent years,procuratorial organs have made great achievements in procuratorial supervision over execution of death penalty and imprisonment,and established a relatively complete working mechanism.However,supervision of the execution of the property punishment,that is still not on the court in the implementation of property punishment in the anomie,delay,one-sided implementation of a series of problems timely and effective supervision,serious damage to the fairness and authority of criminal justice,protection and development trend and the court more and more punishment for property and citizens pay more and more attention to the legitimate property rights does not adapt.Therefore,it is not only a theoretical problem but also an urgent practical problem to study the procuratorial supervision of property penalty execution from the perspective of procuratorial organs.This paper discusses the theory starting from the procuratorial organs on the implementation of the supervision problem in the process of defining the property punishment,property punishment execution scope of procuratorial supervision,theoretical basis and legal basis;and through the investigation of the foreign and the property punishment execution procuratorial supervision practice and related regulations,summed up the implementation of procuratorial supervision in foreign countries in terms of property loss the penalty and available for our reference.As the focus of the article,the author from the perspective of empirical analysis from the procuratorial supervision problems of property punishment in China:Problems and property punishment execution procuratorial supervision means too one-sided;two,there is no scientific and orderly set the property punishment execution procuratorial supervision procedure;three,property punishment execution procuratorial supervision with echoes of the lack of accountability mechanism.Analysis of the above problems,the author puts forward the property punishment execution procuratorial supervision from the following aspects:first,the change of thinking forward execution procuratorial supervision measures of property punishment;second,the innovation of property punishment execution procuratorial supervision procedures;third,property punishment of personal credit supervision after the shift;fourth,property punishment execution procuratorial supervision information sharing platform.Objective to realize the implementation of property punishment,in addition to improving the property punishment execution rate,to maximize the legitimate property rights will be executed in the procuratorial supervision to protect people and other stakeholders,in order to maintain the fairness and authority of the state judicial.
