Investigation Report On The Application Of Juvenile Delinquency

With the continuous development of the economy,social conflicts initiated by the transformation of the social structure have become increasingly prominent,and the crime is in a more serious development trend.The teenagers should be the hope of the country and the future of the nation.However,the juvenile delinquency has become a prominent social problem in our country.The immature physiology and psychology,limited cognitive ability and insufficient control ability of the teenagers result in the significant differences between the crime committed by the teenagers and adults;in addition,the teenagers' special physiology and psychology also determines their strong plasticity.Therefore,the disposal of juvenile delinquency cases should be different from that of the crime committed by the adults.However,What is the present situation of juvenile punishment? Is there a shortage? Whether we should set up the criminal penalty system which is different from the adult and so on,it is urgent to arouse the attention of the theory and practice circle.The author has been working in S County in Chongqing for many years.Since this county is a typical rural one with basic features of remote agricultural counties in China,the author takes this county as an example to make investigation the application of juvenile punishment.Through the study of S County juvenile penalty situation,to understand the status quo of penalty punishment,Chinese rural minors to the basic principle of criminal law,an antidote against the disease,the provisions,take effective measures to optimize the juvenile penalty system,in order to prevent and curb juvenile crime in rural areas to Chinese.Apart from introduction,this thesis is composed of five parts,about 20,000 words in total.Part One elaborates the investigation purposes and significance.The author selects S County in Chongqing as the blueprint for investigation since S County is a typical agricultural county with the typical characteristics of Chinese rural areas in the social transformation period,that is,young and middle-aged labor force migrates for work and the unattended children and the old become the main resident population.Taking S County as the blueprint for investigation is conducive to understanding the status quo of the juvenile delinquency in Chinese rural areas,the occurrence and development of the juvenile delinquency therein and so as to provide reference for the containment and prevention of the juvenile delinquency therein.Part Two elaborates the time and place,objects,contents and specific methods of the investigation.The author takes advantage of working in S County Procuratorate,juvenile delinquency data from 2012 to 2016 were analyzed,based on the status of juvenile criminal cases of minors,punishments,minor penalty applicable objects,minor penalty charges and other aspects of the investigation and analysis,to understand the situation of juvenile penalty.Part Three is about the findings of the application of juvenile delinquency.Through the summary of 2012 to 2016 of minor criminal cases penalty situation,and analyze the data,summarizes the characteristics of a minor penalty type,object,applicable penalty penalty charges in three aspects.Part Four analyzes analyzes the reasons for the application of juvenile delinquency.Through the analysis of the data from 2012 to 2016,this part analyzes the reasons for the formation of juvenile punishment.The first is a complete juvenile penalty system is not established by legislation,juvenile penalty system many omissions;the second is the implementation of penalty doctrine restricts the juvenile penalty measures;the third is a minor penalty strict grasp the magnitude of improper misconduct penalty;the fourth is a minor penalty measures lack of rationality;the fifth is a minor non penalty measures are not complete.Part Five is to improve the application of juvenile punishment.Investigation and analysis of data and conclusions based on the proposed improvement of juvenile delinquency suggestions: one is to establish a juvenile penalty system in legislation;the two is to improve the juvenile penalty system;the three is to improve the juvenile non penalty system.
