Research On Police Intervention In Domestic Violence

With the implementation of the anti domestic violence law of the People's Republic of China,the public security organs have a clear legal basis for the intervention of domestic violence,which is of great.significance to promote the stability and harmony of the family and society.However,the police are facing various problems still in the process of intervention in domestic violence,the public security organs in the existing legal mechanism should be how to cope with domestic violence,this is the actual problem of the current situation urgent.This paper expounds the domestic police intervention in domestic violence in the face of difficulties in practice,combined with the analysis of the foreign and overseas police anti domestic violence mechanism,puts forward the practical method of police intervention in domestic violence,and strive for the perfection of police work and provide theory.This article is divided into three parts,including the introduction,the main body and the conclusion.The text is divided into four chapters.The first chapter is a brief introduction to the basic theory of police intervention in domestic violence.Mainly focus on three aspects:one is to define the concept and form of the "anti domestic violence law" on domestic violence;two is the legal basis for the domestic police intervention in domestic violence;three is the working principle of the police intervention in domestic violence.Among them,the academic community is controversial about the concept,form and standard of domestic violence.The second chapter is the analysis of the current situation of Chinese police in the practice of anti domestic violence."Provides a legal basis and procedures for the disposal of anti family violence law" and local legislation for police intervention in domestic violence,but in practice there is still insufficient.Such as the lack of correlation with the anti domestic violence law enforcement regulations,police intervention domestic violence location unknown,police intervention in domestic violence lack adequate social support and other issues.The author takes a field research report as the empirical evidence,and analyzes the current situation of the grass-roots public security organs involved in the practice of anti domestic violence.The third chapter introduces the model and experience of police intervention in domestic violence outside the country.It mainly introduces the three kinds of anti family violence;the police is a community centered mode;two is a positive intervention mode of the Danish police for domestic violence;three is the legal intervention in the Taiwan police anti domestic violence mode.And on this basis,we should sum up the model which is worthy of reference and use for reference.The fourth chapter puts forward some opinions and suggestions on how to effectively deal with domestic violence in China's public security organs.From the reflection of China's anti domestic violence in police practice encountered problems,proposed the establishment of domestic violence disposal capacity,multi institutional linkage mechanism,strengthen the police in anti domestic violence in the work of perfecting investigation of proof mechanism and emergency rescue,police to raise their own quality of four kinds of measures.
