The Risk Of Private Bank And Its Legal Regulation

As an important part of the reform of China's financial system,private banks have shown more and more important roles.In 2013,the CBRC officially announced that the banking sector allowed private capital to join,so private banks had developed rapidly and injected new vitality into the market economy of our country.Private banks have great innovation significance in the development history of our country's economic system.The accurate positioning of private banks is the basis for the study of private banks.The research in this paper is different from other state-owned commercial banks,private banks,which have features of the modern joint-stock banks,at the same time,because of its unique private capital,privately operated,privately owned and privately governed,and other features,which are generally different form the state-owned commercial banks.Different from state-owned banks,private banks have great differences in terms of property rights,system design and business models.The important thing is that they have the advantage that state-owned banks do not have in market efficiency.The emergence of private banks effectively complements the state-owned financial system and has an indisputable effect on improving the financial system of our country.Therefore,the development of private banks is the realistic need for our country's economic development.But in the process of development,private banks will not only produce the same risks as other banks,but also bring unique risks because of their own characteristics,which will restrict the development of private banks.The thesis mainly studies the legal risks and its legal regulation in the process of the development of private bank system.Referring related private bank risks and legal regulation data at home and abroad,analyzing the advantage,disadvantage,opportunity,and challenge.Briefly discussing the current situation and feasibility of private bank.And taking the American Community bank as study object,analyzing its success and its influence,bring more enlightenment for anti-risk of private bank in China.Then summing up several key problems of our private bank,and on this basic,coming up with efficient suggestion and countermeasures for our private banks.
