Research On Trade And Investment Dispute Settlement Mechanism Between China And Central Asian Countries

In today's international community,global issues such as hegemonism,power politics,geopolitical issues,conflicts and poverty have been standing out,hindering the normal development of new international economic order.President Xi has initiated the idea of a Community of Shared Future for the Mankind which proposes international community,as a comnunity of shared interests,shall make efforts to build a Community of Shared Future for the Mankind,achieving mutual benefit,mutual development and win-win result.One Belt and One Road is the most important way to bring a Community of Shared Future for the Mankind into reality.Under the guidance of principles of co-discussion,co-construction and sharing,China and countries along One Belt and One Road work together to open up a new chapter of economic and trade cooperation.Along with One Belt and One Road making progress,trade and investment interaction has been increasing between China and Central Asian countries which are the important countries along Silk Road Economic Belt.Trade and investment interaction unavoidably gives rise to trade and investment disputes.Therefore,how to settle the trade and investment disputes effectively and promptly between China and Central Asian countries has been getting more and more attention from legal scholars and professors.Thus,it is urgent and necessary to establish trade and investment dispute settlement mechanism between China and Central Asian countries from the perspective of a Community of Shared Future for the Mankind.At present,trade and investment dispute settlement between China and Central Asian countries has only been confined to individual case settlement under domestic law and bilateral or multilateral treaties.Furthermore,most disputes have been settled through political and diplomatic means and it has not formed a thorough dispute settlement mechanism.In addition,Central Asian countries' domestic law has different stipulations on trade and investment dispute settlement,and it is the same with bilateral or multilateral treaties.Some domestic law and bilateral or multilateral treaties even do not have stipulations on trade and investment dispute settlement and they have no regard for the fact that Central Asian countries are developing countries.That shall impair legitimate interest of China and Central Asian countries,hindering the development of trade and investment cooperation.Researches on trade and investment dispute settlement between China and Central Asian countries are scanty which mostly combine Central Asian countries' features and conditions on trade and investment.Until now,no one has done researches on trade and investment dispute settlement mechanism between China and Central Asian countries from the perspective a Community of Shared Future for the Mankind,combining the fact that Central Asian countries are developing countries.In view of this,this thesis shall elaborate how to establish the trade and investment dispute settlement mechanism between China and Central Asian countries from the perspective a Community of Shared Future for the Mankind.To conclude,this thesis shall discuss a Community of Shared Future for the Mankind and One Belt and One Road,and integrate those ideas into the design of trade and investment dispute settlement mechanism between China and Central Asian countries.Meanwhile,this thesis shall draw on the experience of existing regional economic organizations' dispute settlement mechanism through methods of literature survey and comparative analysis,making efforts to present basic principles and measures on how to establish trade and investment dispute settlement mechanism between China and Central Asian countries from the perspective a Community of Shared Future for the Mankind.I sincerely hope that this thesis could make a contribution for propelling trade and investment cooperation between China and Central Asian countries under a Community of Shared Future for the Mankind and One Belt and One Road.
