As an important part of the Internet industry,the online game industry has developed rapidly and has continuously expanded its market with the integration of new technologies.Many players are attracted to it because of the entertainment,interactivity,participation and playability of online games.The deep integration of digital network technology and online games makes online game infringement different from the past.In the initial stage of the development of online games,online game infringement is mainly reflected in contracts,job disputes,and plagiarism of game codes.Now more infringements of the overall picture and copyright issues of online game screens have become hot topics in the field of copyright.The main problems include: the legal attribute and work definition of online game screen,the copyright ownership of online game screen,the principle of copyright infringement of online game screens and the legal liability of online game screen copyright infringement.In terms of specific content,the article is divided into six parts in addition to the epilogue.The first part is the introduction,which mainly summarizes the research background,research status,significance and purpose of the online game screen copyright issues.The second part is analysis of the legal attribute and the qualitative analysis of works of the online game screen.First of all,it determines the research object of this paper through the network game screen and online games,online game interface boundaries.Secondly,in-depth analysis of the workable elements of copyright,and definition the legal attributes of network game screen that works.Thirdly,explore the characteristics and essential characteristics of online game screen,and distinguish online game screen from compilation of works.The paper draws many similarities with the performance and creation process of movie works.Combined with the basic principles of copyright,it is believed that online game screens can protect audiovisual works.The third part is the analysis of copyright ownership of online game screen.The interaction of online game screen,the behavior of players and players may affect the attribution of the copyright of online game screen.Judging from the judicial cases and theoretical analysis,it is not the "creative act" in the sense of copyright law,nor is the "performer" in the sense of copyright law.And as an online game developer,online game developers are copyright owners of online game screens.The fourth part is the analysis of the copyright infringement judgment of the online game screen.It is considered that other methods can be appropriately introduced to determine substantial similarity.The fifth part is the analysis of the legal liability for copyright infringement of online game screens.Focusing on the analysis of the legal responsibilities of online game platforms,and based on the operating model of online game platforms,it analyzes the direct tort liability and indirect infringement liability that online game platform providers may assume.The last part is to improve the online game screen copyright protection recommendations.From the relevant aspects,the protection of online game screens is proposed.
