Research On The Injury Accidents Of College Sports Based On 20 Cases Of Court Judicial Documents

Since the State Council issued the No.46 document in 2014,China has ushered in a sports boom in the 21 st century.More and more college students participate in sports.As younger generations,they are energetic and love sports.However,due to its long-term presence in the campus environment,it is in a protected state,self-risk prevention awareness,and awareness of dangerous responses.The frequency of injury accidents in college sports is high,and the occurrence of injury is often instantaneous,directly injuring students' bodies.The accidents are often accompanied by disputes.The causes of disputes may be due to accidents.The two parties did not reach agreement on the treatment method,and may be accidents.The responsibility of the main body is difficult to determine,there is controversy in the division of responsibilities,the need for judicial intervention;regardless of the cause of the accident is difficult to successfully resolve,can not affect the student's study life,health,affect the image of colleges and universities.This paper adopts the case analysis method and selects 20 court judging documents for college sports injury accidents,and compares relevant literature materials to conduct comparative analysis.It attempts to conduct research from the following aspects:1.Conceptually define the basic concepts of sports injury accidents in colleges and universities,and sort out the existing research to illustrate what legal relationships exist in college sports injury accidents and the impact of the definition of these legal relationships on case resolution;The classification of sports injury accidents in colleges and universities shows how different types of accidents deal with different ways and applications.The basics of safety management in universities are introduced.2.In-depth understanding of the status quo of college sports injury accidents reflected in the referee documents,sorting out the characteristics and causes of sports injury accidents in colleges and universities,and clarifying the process of accident resolution,so as to fully understand that China has adopted the sports injury accident treatment in colleges and universities.What methods should be used to analyze the problems in the dispute resolution process in order to find a more appropriate solution;3.Through a clear exploration of the problems in the processing of the reaction in the judgment documents,identify the specific forms of problems and the causes of the problems,and try to find suitable solutions in accordance with the existing legal provisions and handling methods;4.Find out where the problem lies in the handling of the status quo of the referee's documents and put forward corresponding solutions.We believe that the need for multi-collaboration,a sound legal system,a sound university management system,and the student's own self-safety awareness are all indispensable.
