Study On The Adoption Of Electronic Police Enforcement Evidence

The electronic police is a high-tech manager method that can enforce law enforcement on the road 24 hours a day and collect the illegal activities of vehicles within its monitoring range.Nowadays,electronic police has been widely used in our traffic management.Its difference from traditional traffic police is the separation of evidence collection and review.The electronic police took the driver's evidence of violating the traffic regulations and sent them to the illegal information center of the traffic department.However,whether these evidences can be used as a basis for punishment of the perpetrators still requires policemen to conduct further examinations.The traditional law enforcement of traffic police from the forensic to the punishment process was completed at the scene where the police discovered the illegal behavior.Although this law enforcement method is highly effective,it is seriously affected by the subjective factors of law enforcement personnel,and face-to-face law enforcement is also likely to cause conflicts between managers and managers.The e-police law enforcement evidence is a factual basis for handling traffic violations,and it plays a decisive role in the results of traffic law enforcement.With the widespread application of electronic police in our country,the issue of law enforcement evidence adoption has received more and more attention from the public.In fact,many incidents of administrative reconsideration and administrative lawsuits occur each year because administrative counterparts do not convince the results of electronic police evidence adoption.Therefore,solving the issue of e-police evidence admissibility has become the most important issue to be solved in the regulation of electronic police enforcement.At present,there are four problems in the law enforcement evidence of electronic police: inadequate legal norms lead to excessive discretion in evidence admissibility;the transportation department adopted the evidence but the source of the evidence was not legal;the subject of the evidence is not qualified as an administrative subject;there are technical defects in the electronic police itself,resulting in errors in the collected evidence.If these issues are not resolved properly,electronic police enforcement will fall into an embarrassing situation.The general public's resistance to electronic police will gradually increase and think that the electronic police is an instrument used by administrative agencies to fine and obtain benefits.To standardize the adoption of evidence for electronic police enforcement and promote the sound development of electronic police enforcement requires the following aspects: first,speed up the pace of legislation,improve the relevant legislation of electronic police,and reduce the discretionary power of electronic police evidence adoption in the transport sector,while establishing a unified law enforcement latitude;second,take evidence of legal sources;Third,strengthen the management and supervision of the subject of e-police evidence admissibility,standardize the scope of the subject of evidence admissibility,and establish a qualification and certification system and personnel supervision system for evidence admissors;fourth,improve the technical defects of the electronic police,formulate national uniform technical standards and acceptance standards,and provide for a unified detection period and evidence format.
