The sharing economy which relies on the Internet technology such as large data and cloud computing is growing.In the sharing economy model,individuals who are unfamiliar with each other meet their own needs.The transaction of the sharing economy is more convenient and everyone can really participate and experience the joy of the transaction.People are both sellers and consumers in the sharing economy model.The advancement of technology brings about a convenient transaction process.Cognitive surplus,material surplus,and time surplus are the material foundations of exchange.If the sharing economy model only makes use platform to trade,it only accelerates the process of transaction,and its essence is no difference from the industrial economic mode.At present,there are many enterprises and organizations which are always under the guise of sharing economy operates the business of traditional economy in the name of new economic model in order to avoid the supervision of government.It is necessary for the administrative body to accurately define the sharing economic model,and then choose the appropriate regulatory path to deal with the risks of the sharing economy model.At the same time,it is necessary to pay attention to find the detection of regulation problems of the sharing economy model and make up the loopholes in regulation and solve the regulatory problems.In order to realize substantial development of the sharing economy model,China must have a new concept of administrative law.The government regulators should fully absorb the opinions of market participants.Policy legislation needs of the sharing economy should be “open legislation”,“democratic legislation” and “scientific legislation”.From a higher strategic perspective to share the meaning of economic development,the legislation needs of the sharing economy should follow the market-oriented thinking and holds a more inclusive and promotional attitude towards sharing economy,such as the development of the "negative list" of sharing economy by subdividing industry policy and action plan.In the macroeconomic aspects of the sharing economy and the “Internet Plus”,the central government and local governments have issued many policy documents and action plans.However,in the areas of transportation,accommodation,services,labor,retail,and finance that are related to the sharing economy model,the relevant support and encouragement policies are rare.For example,in the travel industry in which there are the most regulatory obstacles,we should establish a negative list of the sharing economy by optimizing policies and laws and regulations,and clearly define the "sensitive" areas of the sharing economy.Outside the negative list,the industry allows economic enterprises to have the enterprises' own entry and exit,and clearly understand the obstacles in terms of access permits and labor relations.We should improve the system of credit investigation by adopting flexible systems such as public consultation and soft law and jointly promoting the development of sharing economy.In order to further improve the mechanism of the social security and welfare,the relevant agencies should provide necessary insurance and benefits for the sharing economy,and the relevant agencies should encourages sharing economic platform or jointly establish the compensation funds with insurance companies.The government should guide the capital market in an orderly way,and explore the cooperative governance model by means of financial support to the sharing economy model and the components of the self-discipline organization of the industry.The relevant departments shall properly define and resolve the security issues of sharing economy.We will further strengthen broadband infrastructure construction and speed up the cost reduction so that more people can join the sharing economy platform and participate in the services of the sharing economic.The government should consider launching a model city for the sharing economy,and use cities as a unit to integrate the existing public and private resources of the city and effectively mediate the gap.The government should consider integrating the sharing economy into government procurement and promote the implementation of the transfer payment compensation system.The sharing economy model has affected hundreds of millions of people.And the sharing economy will inject a powerful new momentum for China's economic growth.The administrative laws should follow the trend of the sharing economy and turn the sharing economy into a powerful engine for the economic growth.
