With the development of "Internet+" and big data,the sharing economy based on the Internet platform arises at the historic moment.Shared economy is an economic model in which both suppliers and demanders publish supply and demand information through the Internet platform,and integrate information through the network platform to facilitate transactions,so as to achieve mutual benefit and win-win situation.Shared economy,as a newly emerging economy,shows great vitality.It brings convenience to the public,but also brings a series of challenges to the traditional government regulation.Shared economy is different from traditional economy.Its flexibility,inclusiveness and complexity bring challenges to traditional government regulation.Firstly,the traditional concept of government regulation does not conform to the essence of the shared economy and hinders the healthy development of the shared economy.Secondly,the traditional government regulation means are single,often relying on high-powered command-control means to supervise the market subjects,which to some extent hinders the innovation of the shared economy.Finally,the traditional single government regulation subject is difficult to cope with the flexible and changeable co-operation.Enjoy the economy,the cost of regulation is high,and the efficiency of regulation is low.Therefore,it is difficult to avoid regulation failure by relying solely on traditional regulation.However,only relying on platform enterprises'self-regulation,their pursuit of maximizing benefits makes it difficult to achieve the goal of social regulation,which will lead to self-regulation failure.It can be seen that it is difficult to overcome the market problems brought by the shared economy by relying solely on government regulation or self-regulation of enterprises.Therefore,it is necessary to introduce cooperative governance into the shared economy.Cooperative regulation is a governance mode in which enterprises,non-governmental organizations and the public participate in government regulation as regulators.It emphasizes the diversity of regulators and regulatory means,makes full use of the advantages of each subject,cooperates with each other and depends on each other to achieve regulatory objectives.As a new development of governance theory,the study of cooperative regulation should proceed from the perspective of administrative law,have a detailed comb of government regulation theory,and combine the characteristics of shared economy,in order to formulate a cooperative regulation path more in line with the current situation of shared economic development.This paper makes a theoretical explanation of cooperative regulation from the concept,subject scope and mode of cooperative regulation,and redistributes regulatory responsibility on the premise of accurately locating the subject of regulation.Each subject performs its own duties and cooperates fully to achieve regulatory objectives.In addition,it combines the shared economy with China's regulatory status quo,makes full use of multiple regulatory tools,and explores specific regulatory paths in line with China's shared economic development.The purpose of this paper is to study the regulation of shared economic cooperation,explore a more medium-sized governance path,so as to solve the current regulatory failure problem,in order to promote the modernization of China's governance system and governance capacity,and realize the benign governance of society.
