Study On The System Of Social Protectiion For Juveniles In China

It can be seen from our country civil cases that the research on the protection of juvenile is still lagging behind.Now,People are paying more and more attention to the protection of the rights and interests of juvenile.In civil cases,social protection of juvenile is a great protection for juvenile' s rights and interests.Social protection is also an important symbol of the progress for juvenile civil judicial.However,at present,our country' s laws and regulations have not yet made specific provisions on the social protection system.So there is still not yet a relatively complete social protection system.This system is still in the stage of exploration.In the practice,for the protection system,different courts from different place have different understandings and practice.In this case,this system appeared a lot of problems at the same time.For example,the social security guards' qualifications and litigation status are still not clear;the nature of the investigation report of social protection is unclear;Social protection cannot be widely recognized and so on.These problem makes the rights and interests of Juveniles can' t be properly protected in civil cases.This article tries to analyze the system of social protection of family affairs firstly,analyzing the status of the legislation and practice of the civil cases'Social protection system in our country,and analyzes the existing problems in the exploration and practice of the system in our country,and then combines the reality of our country and through the related systems of the United States and Germany,on the basis of analysis and reference,it puts forward some suggestions to perfecting the social protection system in our country on perfecting legislation,making up for the lack of law,establishing the principle of social protection system,defining the scope of the application of social protection and the nature of the investigation report and so on.
